“Plaintiff suffered injuries, became ill, in pain, distressed and incapacitated; and had to undergo medical treatment and advice,” reads the lawsuit, which includes the Catch NYC establishment itself and its owner, Mark Birnbaum, for allowing the assault through of negligent behavior by its employees.

The lawsuit seeks compensation for the victim and emphasizes that Foxx’s actions will “permanently” affect her as a result of the “sexual abuse and aggravated assault” she suffered.

The case was filed under New York State’s ‘Adult Survivors Law’, which is set to expire this week and allows victims to sue their alleged sex offenders even if the crimes have expired.
