ACT chairman requests to be released in case of alleged abstentions of IDR 117 billion

Chairman of Aksi Cepat Tanggap Foundation (ACT) Ibnu Khajar filed a memorandum of opposition or objection to the prosecutor’s charge in the case of alleged misappropriation of donations from heirs of victims of the Lion Air 610 plane crash. Ibnu Khajar asked the panel of judges to cancel the accusation by the prosecutor.

“We submit a request to the panel of judges, which we honour, so that, for the sake of justice, we can make the following decision, accept and grant the objections or exceptions to the accused in their entirety,” said Ibnu Khajar’s team . lawyers during a hearing at the South Jakarta District Court on Tuesday (11/22/2022).

“Declaring the prosecutor’s indictment null or at least unacceptable,” he continued.

The legal team has asked the jury to release their client from this case. He also asked the jury to uphold all objection notes submitted by his client.

“Release the accused from custody. Release the state’s court costs,” he said.

Ibn Khajar was accused of embezzling donated funds. The prosecutor said the embezzlement by ACT officials was related to Boeing donations for the families or heirs of victims of the Lion Air 610 crash.

The indictment alleged that Ibnu Khajar committed the act together with former ACT president Ahyudin and Hariyana Hermain (HH), who were named as one of the coaches of ACT and held other senior positions at ACT, including management of finances. The charges for each defendant were made separately.

“Whoever performs, orders to perform and participates in the performance of acts, intentionally and unlawfully possesses goods that are wholly or partly owned by others. why they get paid for it “This act was committed by the defendant Ibnu Khajar,” the prosecutor said as he read the indictment at the South Jakarta District Court on Tuesday (11/15).

This case started on October 29, 2018, when there was an accident with Lion Air flight number 610, with a Boeing 737 Max 8 aircraft, which crashed after take off from Soekarno-Hatta Airport, Jakarta, Indonesia. The accident resulted in the deaths of 189 passengers and crew members.

Then, The Boeing Company or Boeing provides $25 million in funds through the Boeing Financial Assistance Fund (BFAF) for the families or heirs of the victims of the Lion Air 610 crash. Additionally, Boeing provides $25 million in funds as Boeing Community Investment Fund (BCIF), which is a philanthropic outreach to local communities affected by the crash.

“Where the funds were not received directly from the victim’s heirs, but received from a charitable organization or a third party nominated by the victim’s heirs,” the prosecutor said.

Each heir of the Lion Air 610 victim received compensation from Boeing in the amount of US$144,320 or IDR 2 billion. ACT then contacted the victim’s family and said they had been nominated by Boeing to become the institution that would manage Boeing’s corporate/BCIF funds.

“That later as many as 189 families of victims as heirs received compensation from Boeing company, that is, each heir received funds of USD 144,320 (one hundred and forty-four thousand three hundred and twenty US dollars) or Rp. 2,000,000,000.00 (two billion rupees) (exchange rate of IDR 14,000), where the compensation is received directly from the heirs themselves,” the prosecutor said.

“The ACT Foundation contacted the victim’s family and said that the ACT Foundation had received a mandate (appointed) from Boeing to become the institution that would manage welfare funds/BCIF from Boeing,” he added.

During the trip, ACT asked the victim’s family to accept a $144,500 welfare fund. The prosecutor alleged that Ibnu Khajar, along with Ahyudin and Hariyana had used the Boeing Community Investment Fund (BCIF) in the amount of Rp. 117.9 billion, outside its designation. Ibnu Khajar and others used the money without the permission of the heirs of Lion Air 610 victims.

“That Defendant Ibnu Khajar as Chairman of Aksi Cepat Tanggap Foundation and also serves as Senior Vice Chairman of Partnership Network Department of GIP along with Witness Drs Ahyudin as Chairman of Global Islamic Philanthropy President and Witness Hariyana bint Hermain as senior vice president of operations GIP and also as Director Aksi Cepat Tanggap Foundation used BCIF funds in the amount of Rp 117,982,530,997 outside its designation, i.e. for activities outside the implementation of Boeing without permission and knowledge of the heirs of the victims of the Lion Air Boeing 737 Max 8 crash or the Boeing company itself,” the prosecutor said.

According to the prosecutor, the value of the planned budget for the construction of educational facilities approved by Ibnu Khajar is far less than the value of the amount of money received by the ACT Foundation from Boeing.

“Although the defendant, Ibnu Khajar, knew that the use of BCIF funds must be in accordance with the implementation of the Boeing program and the expenditure for administrative costs must be of reasonable and ordinary value,” he said.

As a result of his actions, Ibnu Khajar and others were charged with violating Article 374 of the Criminal Code, Article 372 of the Criminal Code in conjunction with Article 55 paragraph 1 1 of the Criminal Code.
