After holding a small discussion with the official defender of the Court, just a few minutes before the debate began that has him as the only defendant for the double attempted murder that occurred in October 2017 to the detriment of his ex-partner and the lawyer of the woman, the police officer Rael Muller (37) asked yesterday for the third time to the members of the Criminal Court One of Eldorado the change of sponsor in the trial.
And after reading the order to raise the case file to the parties, the magistrates granted the defendant’s request and chose to go to an interim room until tomorrow, a day where the process against the uniformed officer is expected to resume. a new private attorney already appointed by Muller.
After almost 50 days of the last suspension -the first was on March 2 of last year-, yesterday the uniformed man arrived at the judicial compound together with the official defender of the court, Rodrigo Torres Muruat, with whom he had a long talk moments before the start of the judgment.
As he was able to witness this morning, during the talk the defendant recriminated with a high tone the lawyer who supposedly was not doing his job. He even accused him of harming him in the process before the stunned gaze of journalists and other members of the Court who were witnessing the tense dialogue.
On the other hand, as it did not happen in the other opportunities, the cash at no time yesterday advanced its intention to reach an abbreviated trial agreement, as it did on February 8, when in principle it asked to speak with the Prosecutor’s Office to set a grief, although later he went back in his steps and fired who at that time was his lawyer.
That is why, minutes before 8.30, Judge Teresa Ramos -president- and her peers Lyda Gallardo and Atilio León entered the premises to begin the long-awaited debate.
Although after reading the accusation that weighs on the cash, the latter asked to speak and made the aforementioned change of defender.
According to sources consulted by this medium, after the departure of Torres Muruat, yesterday it was recorded before the parties that the private attorney Reyes was the one who assumed the representation of Muller.
And although from the defendant’s side it was expected that after the aforementioned modification the debate could be rescheduled for later so that Reyes can read the complete file in time, this finally did not happen.
During the few minutes that the first day lasted, the representative of the prosecution, Federico Rodríguez, asked that the aggravation of violence due to the use of firearms be incorporated into the accusation against Muller. Requirement that was granted by the judges.
It should be remembered that the order to bring the defendant to trial was sent to the Court under the accusation of simple homicide and double aggravated homicide by the couple’s relationship and by mediating gender violence, both in a degree of attempt and unlawful deprivation of liberty, aggravated by the condition of a public official, all in real competition.
Two witnesses were missing
For yesterday’s session, it was expected that three witnesses could give testimony about what happened on the morning of October 23, 2017 on National Route 19, in Bernardo de Irigoyen, although two of them did not attend the recitno and justified the failure due to issues of illness. Both are neighbors of a farm where the victims asked for help after the police shooting on the road.
Who did attend was Mario Durán, one of the victims in the case.
The lawyer, current head of the defense attorney for Bernardo de Irigoyen, at the time of the event was acting as the legal sponsor of Vanesa Peralta, Muller’s ex-partner, in a lawsuit for food that the woman had initiated before the Eldorado Family Court.
It was precisely when the two victims were traveling to a hearing in the Labor Capital in the lawyer’s Chevrolet S-10 that the attack occurred.
Finally, Durán did not have the chance to testify at the trial, although in a brief dialogue with this medium, he indicated that he hopes tomorrow to be able to finalize said procedure and thus end at once with what he considers an “abuse of procedural norms” by part of Muller.
“There is no type of nullity, even for the benefit of the defense. He is abusing everyone with what he does, something he is going to oppose for sure because he knows that there is overwhelming evidence against him, ”added Durán, who during the investigation stage of the case was constituted as a private plaintiff in the investigation.
