Defendant in the murder case of six members of the Laskar Defenders of Islam (Islamic Defenders Front)REIT) from KM 50 Cikampek Toll Road, First Brigadier Fikri Ramdhan and Ipda Mohammad Yusmin Ohorella stated that they refused to submit a memorandum of objection or exception.
This rejection was conveyed by the attorneys for the two defendants in separate trials at the South Jakarta District Court (PN Jaksel).
At first, after the Public Prosecutor (JPU) read out the indictment, the chairman of the panel of judges, M Arif Nuryanta, asked Fikri if he would give an exception. Fikri then replied that it would be conveyed by his attorney.
“The defendant’s legal advisory team did not file an exception against the above-mentioned Public Prosecutor’s Indictment,” said Fikri and Yusmin’s attorney, Henry Yosodiningrat, Monday (18/10).
Although he did not file an exception, Henry said there were several records related to the actions taken by his two clients.
According to Henry, the shooting incident was part of the attitude of former FPI frontman, Rizieq Shihab, who refused to comply with the summons from the Jakarta Metro Police investigators regarding the crowding case in Petamburan.
In addition, the Polda Metro Jaya also received information that the Presidium Alumni (PA) 212 would surround the Polda Metro Jaya and carry out anarchic actions.
Anticipating this, the Polda Metro Jaya then took a closed action and ordered several of its members to carry out monitoring. However, while carrying out their duties they were attacked by members of the Laskar FPI until finally the shooting occurred.
“When carrying out their duties to provide security protection to the public, it turns out that members of the Police have received treatment from members of the FPI Laskar in the form of acts of violence,” said Henry.
Henry admitted that he was very sorry for this incident. According to him, this incident would not have happened if Rizieq Shihab had been cooperative when summoned by the Polda Metro Jaya as a witness in a case of violation of health protocols.
In addition, members of the FPI Laskar did not attack Fikri, Yusmin, and Elwira when they were brought to the Polda Metro Jaya.
“If only the MRS (Rizieq Shihab) was cooperative in order to fulfill the summons from the Polda Metro Jaya investigators as witnesses in the health protocol case, and did not provoke his followers to surround and whitewash the Polda Metro Jaya by taking anarchic actions,” said Henry.
“And if members of the FPI Laskar did not strangle and beat and did not snatch the weapon of Defendant Fikri Ramadhan, it is certain that this incident would not have happened,” he continued.
After Henry read out his response, Chief Justice Nuryanta asked if the prosecutor would present a witness. The prosecutor then replied that his party would present 8 fact witnesses and 15 experts.
“We plan to present as many as 8 witnesses,” said the prosecutor.
Furthermore, Chief Justice Nuryanta then stated that the trial was postponed and would be postponed again on Tuesday (26/10) next week with the agenda of examining witnesses.
“Our trial has been postponed and we will reopen it next Tuesday on October 26, you are present at this trial. The trial is finished and closed,” said Nuryanta before knocking the hammer.
Previously, Ipda Mohammad Yusmin Ohorella and First Brigadier Fikri Ramadhan were charged with intentional murder which resulted in the death of six members of Laskar FPI in an incident at KM 50 Toll Cikampek, December 7, 2020.
Apart from Yusmin and Fikri, the police have also named another suspect, Ipda Elwira Priadi Z. However, he died in an accident last January.
Meanwhile, Fikri and Yusmin were charged with committing criminal acts individually or jointly. They were charged with Article 338 of the Criminal Code in conjunction with Article 55 paragraph 1 of the Criminal Code regarding intentional murder. They were also charged with Article 351 paragraph 3 of the Criminal Code in conjunction with Article 55 paragraph 1 of the Criminal Code regarding persecution resulting in death.
However, the two defendants have not been detained to this day.
