The review of the accusation against Alejandro Toledo and other businessmen involved in the bribery of Odebrecht in the South Interoceanic project (sections 2 and 3) has been postponed.
Judge Richard Concepción Carhuancho estimated last Tuesday that the mixed request (accusation and file) of José Domingo Pérez should be evaluated by his office on another occasion since his request “is incomplete.”
The reasons for this statement were given in a virtual hearing when the lawyer for the ICCGSA company (included to date as a taxable person in the case), Carlos García Asenjo, maintained that the prosecutor did not rule on the legal person in the accusation nor notified them of it, so another date had to be set for the session.
Although Pérez presented his accusation in August 2020 requesting sentences of 20 and a half years of effective jail for Toledo, the businessmen José Graña Miró Quesada, Fernando Camet Piccone and others, failed to pronounce on the companies Graña y Montero SA, G and M, ICCGSA and JJC, who formed a consortium for the IIRSA Sur road work.
However, the money laundering prosecutor stated that the reason for this was that, to date, the incorporation of legal persons to the case has not yet been ratified. Once this is confirmed or the exclusion is ordered, you may or may not file the accusation against said companies if you deem it necessary.
After the debate on this point, the judge decided to agree with ICCGSA, adding that “the intermediate stage is reserved until the Prosecutor’s office comply with completing the accusation, specifically with regard to the pronouncement on the four companies incorporated into this criminal proceeding ”.
Pérez consented to this decision and must wait for the situation of the companies to be defined and then decide whether to accuse them or request that the case be closed. Afterwards, the judge may set a new hearing date to begin the intermediate stage, that is, control of the requirement, which is the step prior to the trial.
