The website of RTL News Tuesday evening.
“If the company is so keen to make staff come to work earlier, then that extra time must also be paid,” the court in Roermond ruled.
House rules
The woman started working at Dimass in April this year. The distribution company from Haelen takes care of the handling and shipping of orders for web shops. Employees are advised in the house rules that they must be present ten minutes before their shift. Otherwise there would be too little time for instructions from a supervisor and a good handover between the changing teams would falter.
In the eyes of Dimass, the fired woman renounced too often. After repeated warnings, she was fired on the spot in early September.
Severance pay
The woman then went to the judge, who agreed. According to the subdistrict court in Roermond, the woman’s behavior is no reason for an instant dismissal. He therefore declared her termination of service null and void. Dimass has to pay the employee the salary for September and October. The distribution company must also pay the course fees, severance pay and legal fees. In total, this involves a compensation of almost 6000 euros. The woman is said to have changed jobs.
‘Stick for hitting a dog’
Dimass director Peter Walraven informs RTL that he is not concerned about the lost cause. “We wanted to get rid of the employee for several reasons. She had suffered damage in the warehouse for 13,000 euros and had already worn out about seven laptops. But because that is no reason for dismissal, we were looking for a stick to hit the dog with. “
According to the director, the woman would often not have started her work on time. “That is wrong in the statement, because we have not clearly stated it in the letter of resignation. That costs us some money now. But that is fine, because we are glad that we are so away from it.”
