– The Constitutional Tribunal adjudicated solely on the eugenic ground justifying termination of pregnancy. The Act on family planning, protection of the human fetus and conditions for the admissibility of termination of pregnancy still allows for the possibility of termination of pregnancy if it poses a threat to the life and health of a woman, as well as when there is a justified suspicion that the pregnancy is the result of rape – Przyłębska said in an interview with PAP.
According to her, the accusations against the decision that it deprived a woman of the right to choose when their life or health are at risk are completely unfounded.
Przyłębska considered the “manipulation” of the Tribunal that his ruling was a blow against the achievements of medical science. Przyłębska emphasized that the Tribunal’s ruling did not prohibit prenatal testing. – On the contrary – it indicates that the Republic of Poland, in accordance with the constitution, provides everyone with the legal protection of life and health, and one of the means of this protection, in the case of pregnant women, is prenatal testing, said Przyłębska.
– The ruling of the Constitutional Tribunal is not directed against anyone and should not be used by anyone to cause social tensions. These divisions are caused by disinformation, incorrect presentation of the meaning of the sentence and its content, calls to go out to the streets, when there are restrictions on organizing assemblies aimed at protecting life and health – said the President of the Tribunal.
According to her, “accepting aggression, brutal and vulgar language, encouraging the devastation of public property and places of religious worship, desecration of memorial sites, symbols of Polish culture, disrupting prayer, and thus the right to religious practice, is an open rape on the rights that are also protected by the constitution. “.
– Everyone for whom the good of the Republic of Poland is a value should appeal today for social peace, care for the weakest, respect for the law “- she pointed out.” We are not citizens of the universe, but members of a specific political community – citizens of the Republic of Poland and our future depends on our attitude, also the one in the near future – she added.
She also appealed to protect ourselves and others from coronavirus infection, which, “yes, many Poles go through mildly, but there are also those among us who, as a result of the disease, regardless of age, suffer significant health damage and even lose their lives”. – Therefore, let us take care of social distance, let us wear masks in public spaces and help lonely and elderly people – she said.
Last Thursday, the Constitutional Court ruled that a provision authorizing – under the 1993 Act – abortion in the event of a high probability of severe and irreversible fetal impairment or an incurable life-threatening disease is unconstitutional.
