Abolishment of Special Pension Schemes: Impact of Controversial Reform

Adopted in pain and without a vote via 49.3, the reform provides that these special regimes will be abolished for agents recruited from September 2023.

It was as much feared as fought. The government published on Sunday July 30 in the Official Journal the implementing decrees abolishing the main special pension schemes (RATP, electricity and gas industries, notary clerks and Banque de France), provided for by the very controversial pension reform.

The reform provides for these special schemes to be abolished for staff recruited from September 2023. Staff recruited previously continue to benefit from these schemes (“grandfather clause”), but they are not immune to the changes provided for by the reform for all employees.

Thus, for these agents, “the eligibility age is gradually raised by 2 years» et “the duration of insurance required for the full rate sees its ramp-up accelerated”, recalled the Ministry of Labor in a press release. “These changes will begin to take effect from January 1, 2025, the date from which the convergence measures of the previous reforms have completed their ramp-up.he added.

However, the ages for cancellation of the discount in the RATP and electricity and gas industry schemes “remain unchanged”recalls the ministry.

The long career scheme is adapted for these schemes in the same way as for the general scheme, with four age limits for entry into the scheme (16 years, 18 years, 20 years and 21 years), authorizing a departure early retirement “according to four limits of opening rights”, at 58, 60, 62 or 63 years respectively.

In accordance with the provisions of the reform, “the period of insurance contributed necessary to benefit from this device is henceforth reduced to that required to obtain the full rate”.

Et “the personal commitment of caregivers (in family life: editor’s note) is recognized, since four quarters granted in this respect can now be taken into account for the benefit of this device”.

The date of entry into force of the pension reform is September 1, 2023. The government must publish the bulk of the implementing texts before this date.

Some diets that meet “to specific constraints” continue to exist after the reform (sailors, Paris Opera, Comédie Française). The autonomous regimes (liberal professions and lawyers) are not affected either.
