Thiruvananthapuram: A CBI court has ruled that Sister Abhaya’s murder was not a suicide but a murder. Thiruvananthapuram CBI court judge K Sanal Kumar said in the judgment that all the testimonies before the court in the case were credible and validated the role of the accused.
In the final verdict, the court said that Sister Abhaya was beheaded and killed in a well. Sister Abhaya found the accused in the kitchen of the monastery in the early hours of the morning and led them to their murder. In the final verdict, the court observed that the confession made by the first accused Thomas M Kottur to the prosecution witness, Colorcode Venugopal, was strong evidence.
The court ruled that all the statements of Adakka Raju, the main witness in the murder, were credible and in line with the circumstances. It is clear from the testimony and other evidence that Father Thomas Kottur was a regular visitor to the Piast Tent Convent.
The court sees the results of Sister Sefi’s medical examination as another strong piece of evidence in this case. During the CBI trial, the court was informed about the details of the hymen surgery performed by Sister Stuffy to prove that she was a virgin. The CBI court also said that the behavior of Sister Sefi was clear from the witness statements. The verdict said Sefi’s presence in the kitchen area of the convent was sufficient to prove his guilt.
The CBI court also sought action against former crime branch SP KT Michael for trying to sabotage the Abhay murder case. The CBI court also directed the police chief to take necessary action against KT Michael for destroying crucial evidence in the case.
After 28 years of investigation and more than a year of trial, the Thiruvananthapuram CBI court, which conducted the trial in the Sister Abhaya murder case, handed down a severe sentence to the accused. A CBI court has sentenced Father Thomas Kottur, the first accused in the Abhay murder case, to double life imprisonment. Another life sentence was handed down by a court for trespassing on a monastery without murder. The court ruled that all sentences should be served together.
The sentence passed by the court on the first accused in the Abhay murder case, Father Thomas Kottur, is as follows. Sentenced to life imprisonment under Section 302 (murder) and a fine of Rs 5 lakh. Father Thomas Kottur was sentenced to seven years in prison and a fine of Rs 50,000 under section 201 for destroying evidence in the case, and another life sentence under section 449 and a fine of Rs 1 lakh for trespassing into a convent for murder.
However, the court ruled that the prisoners should serve the sentence together and in effect the accused would have to stay in court till the end of their lives. The third accused in the case, Sister Sefiq, was sentenced to life imprisonment under Section 302 (murder) and a fine of Rs 5 lakh, and 7 years imprisonment under Section 201 (destruction of evidence) and a fine of Rs 50,000.
