Indeed, Ababacar Diop wanted to help his friend Modou Dieng who needed a large sum of money for his project. According to him, Mr. Dieng told him that he had a line of credit between Sococim and the bank.
“He came to see me in my office to tell me that he just needs the money for a very urgent project. Moreover, he added that he had lines of credit, it is for this reason that I agreed to sign the agreement in front of a notary, ”he confided to the judge.
In turn, Mr. Modou Dieng did not deny the facts, he says he took steps to get his friend to lend him money for his project. A year later, the official Ababacar Diop, upset, manhandled and dominated by the situation, will end up bringing them before the court of flagrante delicto.
To the question of the judge to know why he agreed to sign this agreement in front of the notary especially since he had to read the contract? He states this:
“I did it out of naivety but he had promised to give me 12 million a year,” he said.
Arrested for the umpteenth time, Ababacar Diop declared having received 12 million FCFA from the defendants by moratorium for the first year. Wanting to recover his money at all costs, he went to the bank and it was there that he was informed that the defendants had borrowed 340 million FCFA when he had to repay 250 million FCFA.
In his argument, the lawyer for the civil party retained orchestrated facts to cause his client to suffer damage. He specifies that things are clear, because this signature had been made before a notary and should be renegotiated. On this, he claimed 300 million FCFA in damages.
In his indictment, the Master of Prosecutions specified that the facts for which Mor Talla Diop and Modou Dieng are being prosecuted have not been established.
For the defense, there was indeed a fraudulent maneuver that prompted their client to sign this agreement.
