Four minors and three adults were singing and drinking at a KTV in Wuxi City, Jiangsu Province, mainland China. One of the teenagers confessed his love to the girl but was rejected. He drank with another suitor of the woman, hugged each other and cried, but the girl only loved him. Wipe away tears. Afterwards, the teenager couldn’t think about it for a moment and fell to his death at home. This was hard for his parents to accept, so he took six co-drinkers, the property management company, KTV, etc. to court for compensation of RMB 1.27 million (approximately NT$5.61 million).
According to comprehensive mainland media reports, at about 9 o’clock on the night of the incident, 17-year-old boy Xiao Xu (all pseudonyms below) invited 20-year-old man Liu, 17-year-old boy Xiao Zhang, 17-year-old girl Xiao Sheng and others to sing and drink at KTV. During this period, Xiao Sheng called over a minor man and two adult men and women. While drinking and singing in the private room, Xiao Xu confessed his love to Xiao Sheng, but the woman was noncommittal. He believed that Xiao Sheng did not refuse clearly just to save some face for himself.
Later, Xiao Xu first drank alone, and then chatted with Xiao Zhang, who had also confessed to Xiao Sheng and was rejected. During the process, the two toasted each other, hugged each other and cried when they talked about their sadness, and continued to clink glasses and drink. Seeing this, Xiao Sheng took the initiative to wipe Xiao Zhang’s tears with a tissue. This move made Xiao Xu very jealous and he threw a wine glass on the spot to vent his dissatisfaction. In order to ease the awkward atmosphere, two adult men and women took the initiative to invite Xiao Xu to play games and drink together.
At about 1 o’clock in the morning the next day, Xiao Xu said he wanted to go home. Seeing that he was a little wobbly when walking, two adults followed him out and sent him to the elevator door. The rest continued to drink and have fun until about 3 o’clock in the morning and went home. At about 5 o’clock in the morning, Xiao Sheng sent a text message to Xiao Xu out of concern, but he never received a reply. At around 10 a.m., Xiao Xu fell to his death in the community where he lived.
After the public security organs intervened in the investigation, they confirmed the circumstances of the above-mentioned case and ruled out the possibility of a criminal case. Xiao Sheng admitted after the incident that he neither liked Xiao Xu nor Xiao Zhang and was just good friends with the two. However, Xiao Xu’s parents could not bear the shock of their underage son’s death. Angrily, his father took Xiao Sheng and other six co-drinkers, the KTV and the community property to court, claiming a total of 1.27 million yuan.
The court held that Xiao Xu was an organizer of group activities. He drank a lot of alcohol during the party due to his own reasons. He later returned to the community building and fell to his death. His own fault was greater. His parents failed to fulfill their guardianship responsibilities and should bear 80% of the responsibility. The main responsibility of If you drink alcohol, fail to fulfill your duty of care, and cause an accident to occur if you leave on your own, you are at fault to a certain extent and you should bear certain responsibilities.
As for the community, the court determined that the relevant facilities met the acceptance standards and had no causal relationship with Xiao Xu’s death, so the property management company did not need to bear compensation liability. In summary, after the first-instance court assessed the claim amount at 1.27 million, it determined that KTV should compensate the family members 127,000 yuan, and Xiaosheng and other five people should each compensate more than 20,000 yuan. After the verdict came out, Xiao Sheng and others were dissatisfied and appealed, but the court of second instance rejected the decision and upheld the original verdict.
