Smoking is allowed, but lighting a cigarette costs a port worker a lot. The man working at the ECT Euromax terminal was caught red-handed when a foreman walked into his work shed. He said it was a cigarette, but there was a burning joint on the floor.
The man, who has been working in the port since June 2023, has to work as a ‘stack turner’ to connect or disconnect containers at the corners. If the containers are moved by crane, it must wait in a one-person stacking booth near the crane for safety.
On May 15, 2024, the man was in his cubicle. The warden immediately smelled hashish when he entered. When he pointed to the joint on the ground, the worker admitted that he had done so and apologized. The warden immediately sent him away from the terminal.
The employee then had a conversation with the team manager and was told he was fired immediately. On the same day he received a letter of resignation.
The man went to court to get his job back. He said at the trial that he had not smoked together. The judge don’t believe italso because he did not say this during the conversation with his boss.
In addition, there was no other colleague in the stack room except the man for hours. The man must have smoked the joint himself.
ECT has a zero tolerance policy when it comes to drugs due to the dangerous work and staff safety. The man knew the rules. So he has to leave and will not get severance pay. He must pay 949 euros in legal costs.
