The Provincial Court of Cádiz has condemned two years in prison yet attorney what sexually abused a minor under the age of 11 in Chiclana. The lawyer avoided holding the oral hearing after to confess the facts and reach an agreement, which earned him a significant reduction in the sentence finally imposed by the court of the Fourth Section. The Prosecutor’s Office requested five years in prison for the defendant while the private prosecution requested six.
Also, the fourth section has suspended the prison sentence to the lawyer for three years under the condition that he does not commit a crime again in that period of time. So for now he won’t go to jail.
The sentence includes as proven facts that in August 2019 the lawyer enjoyed his vacations with his family in a rented house in the town of Chiclana. During August 16 and 18, the now condemned man invited a couple and their two daughters to spend a few days with them. In fact, the court decision specifies, the minors spent the night in the house from Chiclana.
On August 18, around three in the morning, the defendant entered the room where the two girls were, approached the bed of one of them and took advantage of the fact that she was asleep to touch her for a few minutes. The man then left the room, although he returned and touched the girl again in their private areas. At that time, the minor moved and the defendant left. After a few minutes, the defendant entered the room where the victim slept for the third time and sexually abused her.
As a result of this episode, the girl presents clinically significant symptoms of the type anxious.
The condemned has already paid the injured 30.000 euros for civil liability and has recorded 6.000 euros in concept of costs. The payment of these amounts has benefited the defendant, since the court of the Fourth Section has applied the damage repair mitigation at the time of sentencing.
