An attorney charged with $ 79,000 fraud was sentenced to one year in prison with parole and a ban on practicing his profession. In June, after two days of trial, Alejo Fabián Sosa was found criminally responsible for the crime of fraud due to undue detention.
During the sentencing hearing, the prosecutor in the Adrián de Lillo case had asked for the suspension of the sentence of 2 years and the ban from registration for a period of one year. The plaintiff’s lawyer, speaking on behalf of the victim, agreed to the prosecution’s request.
The single-member court has decided to sentence the accused to one year of imprisonment for conditional fulfillment and disqualification from profession for the same period: “these are fair and proportionate penalties for the act committed,” he said.
In addition, the accused must comply with a series of rules of conduct, including not committing new crimes and undergoing judicial control of the population.
The case
According to the prosecution of De Lillo, the lawyer enrolled in the register of the Andes, allegedly defrauded another lawyer and a lawyer for an amount of 79,992 dollars. This took place during the month of July 2006. The defendant, together with another lawyer, signed a compensation agreement to work together on a case. This case occurred in June 2005 in the town of Villa La Angostura and one person died. Among the three, they notified the victim’s wife who had filed a civil action.
The two lawyers and the lawyer agreed that although the fees would be settled in favor of the professional accused of being a citizen, all would be distributed equally among them.
The defendant, between 10 and 15 December 2018, in the city of San Martín de los Andes, collected the total sum of 120 thousand dollars and unduly withheld the part corresponding to his colleagues, who together represented two thirds of the amount charged.
This happened “despite having been expressly instructed to deliver this amount by letter-document dated October 2019”, said the representative of the Public Prosecutor’s Office.
