The Law for Special Declaration of Absence due to Disappearance of Personsafter more than a month since it was approved in the Congress of Puebla.

The new legislation was finally published in the Official State Gazette (POE)whose law establishes that members of that family and “Legal Persons”with or without objection, the request to submit a special certificate of absence.

The request can be made before the competent Court of First Instance, three months after the notice has been lost or the report has been made.

In this way, the procedure is regulated for the authorities to order the confirmation of specific absence due to the disappearance of people and, among the consequences, the authority of the parents of the children of the person who has gone sure sight.

Also, protect the rights and assets of girls, boys and adolescents who are children of the missing person; as well as establishing the custody rights of the girls, boys and adolescents who are the daughters or sons of the missing person.

In addition, the protection of the assets of the victim, including assets received on credit and assets subject to mortgage; Relatives will be able to access the assets of the deceased.

Even those who belong to a social security regime derived from an employment relationship can continue to enjoy the corresponding benefits; The rights of family members and dependents are protected and the dissolution of the marriage bond is established at the express request of the spouse present.
