This July 13, the Dijon magistrate who had proposed sex with his 12-year-old daughter on a libertine site was dismissed from his functions by the Superior Council of the Magistracy. A children’s judge, he has been indicted since June 5, 2020 for inciting the rape of a minor.

Judicial information opened in January 2020
The facts would have taken place repeatedly between October 2019 and May 2020. It is the libertine site on which the announcements had been posted which then warned the Justice, indicating that an individual would propose that his 12-year-old daughter be associated with the sexual antics of consenting adults.
In January 2020, the case was entrusted to the Besançon prosecutor’s office, which opened a judicial investigation for corruption of a minor under 15 years old. This change of scenery in Franche-Comté takes place to prevent the man and his wife, both magistrates and implicated, from being judged by their colleagues.
On June 4, searches were carried out at the couple’s home and offices in Dijon. The wife is then exonerated. Her husband says in fact that he is the sole author of the announcements. In his defense, the former magistrate declares that the sexual relations between strangers and his daughter fell under “fantasies never materialized“. “What seems to be confirmed by the survey“, specifies Étienne Manteaux, the prosecutor of Besançon, indicating that no proof of act has been found.
The former magistrate was also accused of having transmitted photos of his daughter in a swimsuit on a libertine site. However, no child pornography content was found.
On June 5, the man was placed under judicial supervision for bribery of a minor and “unsuccessful provocation to the commission of the crime of rape and the offense of sexual assault”. He is left at liberty and prohibited from exercising a professional activity in contact with minors.
A request for revocation by the Ministry of Justice
On June 17, the Chancellery asked the Superior Council of the Judiciary (CSM) that the man in question be officially dismissed from his functions. This is the heaviest disciplinary sanction that can be imposed on a magistrate. In the eyes of the Ministry of Justice, “this magistrate has lost all legitimacy to enforce the law.“
During his hearing, the defendant said he did not feel “unworthy of this profession“and that he thought”to have been useful and to be able to still be one day“. When her lawyer evoked a man”sick“and”haunted“by a case he had to deal with a few years ago, which involved a multiple-repeat rapist and murderer. He is still under legal proceedings.
