A couple gestated a child with an embryo that was not theirs

In San Isidro, a couple had their third child through in vitro fertilization treatment and when they were leaving the clinic they realized something was wrong. When checking the blood group of the baby, the father realized that it did not correspond to his and his wife’s. So if the baby’s data was not correct, genetically it was not his son.

Given this, a new blood test and a DNA study were made, where both showed the incompatibility.

After the couple’s complaint, the criminal justice system opened an investigation, which was processed in a correctional prosecutor’s office in San Isidro where it will be determined if there was a crime. Federal police raided the sanatorium where the child was born and the fertility institute.

The researchers considered that the problem is in charge of the institute and that the people to whom the embryo could correspond are aware of the situation and are now under study to determine who it belonged to. In addition, they specified that the egg that gave rise to the embryo would have been donated and that it remains to determine who is the biological father among a small group of clients of the fertility center.

Sources in the case clarified that the embryo that they should have placed in the couple who had the baby, they were informed that it turned out to be unsuitable for implantation. This would rule out the possibility that, with a double confusion, a child was born from their embryo.

The criminal case was closed and the courts determined that there had been an error in the medical treatment; without intent, the crimes of identity suppression or fraud cannot be configured, and no injuries have been corroborated for now. The prosecutor’s office dismissed the case, but gave intervention to the family law and the advisor for minors and incapable.
