The Office of Competition and Consumer Protection has recently dealt with the issue of payment gridlocks. Two companies, Bewa from Ruszczyna in the Łódź Province and Zacisze from Warsaw, were fined with a total of over PLN 650,000. – The first of the entrepreneurs is a producer of mineral waters – incl. Evita and Polaris. The second is a wholesaler in building materials and runs paint shops under the name Patio Color. The conducted proceedings showed that the amount of payment gridlocks generated by the companies was PLN 75 and PLN 25 million, respectively – provided by UOKiK.

In the case of three other companies, including Fresh Logistics Polska from Robakowo near Poznań, the Office of Competition and Consumer Protection decided not to impose a fine. – The President of UOKiK stated that entrepreneurs are excessively late with the payment of cash benefits. Although the companies also generated payment gridlocks, no fine was imposed on them. The current wording of the provisions of the Act on counteracting excessive delays in commercial transactions obliges the President of the Office of Competition and Consumer Protection to refrain from imposing a fine if, in the period under review, the sum of payments received by companies after the deadline exceeds the payment gridlock generated by them – he adds.
