/ world today news/ The district court in Peshtera confirmed a fine of BGN 5,500 imposed by the Consumer Protection Commission on a manufacturer whose shoes contained 6-valent chromium 14 times above the permissible standards, writes “Maritsa”.
The chemical is under strict control by the institutions, as it has been found that with increased content it passes through the skin, causes allergic reactions, including shock, attacks and can seriously damage the kidneys, causes oncological diseases.
The case of the cave company cannot be defined as unimportant, as is the opinion of the appellant. The specified property sanction is oriented towards the minimum of BGN 5,000. With these reasons, the magistrates refused to reduce the fine to BGN 5,000, which was one of the company’s requests. By law, the highest penalty for such a violation is BGN 10,000. According to the judges, the manufacturer’s argument that this lot is work shoes is also unfounded.
In an expert opinion attached to the case, it is said that even if it is slightly above the norm – 5 mg/kg, instead of the permissible 4, the chemical can cause an allergic reaction, and in larger doses it is carcinogenic. The amount found in the pairs of women’s caps is 42.2 mg/kg.
The company tried to attack the decision with a counter sample in a laboratory, which showed that the chemical was normal. However, the judges countered that there are no guarantees from where the materials submitted for research were taken and whether they were exactly the same lining in which the fatal doses of chromium were found. The laboratory “insured” itself with a note on the documents with the result: “The sample for analysis was provided by the applicant and was not sealed by a control authority.”
The batch investigated by the Commission was released for direct sales, it is clear from the court decision. At the same time, during the inspection by inspectors, the manufacturer presented laboratory documents for the natural leather inserted as a lining, that it does not contain chromium. The books are mandatory in order for the material to be imported across the border into Bulgaria, they are also required at customs. How the tests were done that showed such a discrepancy in results remains a mystery. The situation is even more mysterious, considering that the lining was imported from Italy, a member state of the European Union. At the request of the union, much lower standards for the content of harmful and dangerous substances were introduced in our country years ago, including hexavalent chromium.
The cave-manufacturing company also appealed the decision of the district court in the city to the Administrative Court in Pazardzhik. The battle continues and only the magistrates will have a say in who is wrong and who is right in the dispute.
Yesterday, our attempts to find a person from the management of the company for comment on the case did not yield results – the only telephone number listed on the Internet did not answer.
