Cracked – Naive idea of burglary – Munich

“Cracked, not broken open” from October 21:

It seems to me that the judge got stuck somewhere a few years ago with his view of technical developments. Data theft is usually associated with Break-ins connected in company networks. And although nobody here leverages a server with a crowbar, but cracks security mechanisms, one speaks of a break-in. And although only security mechanisms have been cracked, this theft is prosecuted.

In the future, insurance companies will probably no longer pay if an apartment has been cleared out and a lock was opened with a suitable tool in the event of a break-in. According to the judge’s interpretation, the apartment should have been broken into for the insurance to pay for the damage. Policyholders should contact their insurance company immediately and ask for clarification of the matter – in writing of course!
