The panel of judges at the Jakarta Corruption Court sentenced him to life imprisonment Benny Tjokrosaputro and Heru Hidayat related to corruption cases Jiwasraya. Both were also sentenced to pay replacement money of more than Rp. 16 trillion.
The verdict was read out by the chairman of the panel of judges Rosmina at the Corruption Court in Jakarta, Jalan Bungur Besar Raya, Central Jakarta, Monday (26/10/2020). The judge sentenced Benny and Heru to life imprisonment and compensation.
“To give trial, stating that the defendant was legally and convincingly proven to have committed the criminal act of corruption together and money laundering,” said Rosmina.
“Sentenced the defendant Benny Tjokrosaputro to life imprisonment,” he added.
Both of them are also required to pay replacement money of up to Rp. 16 trillion more. With details, Benny Tjokro was obliged to pay a replacement fee of Rp. 6,078,500,000,000, while Heru Hidayat paid a replacement of Rp. 10,728,783,375,000.
“If the defendant does not pay the replacement money, the prosecutor will confiscate his assets and auction them off until enough replacement money is paid,” said Rosmina.
In this trial, Benny Tjokro as Commissioner of PT Hanson International Tbk and Heru Hidayat as President Commissioner of PT Trada Alam Minera (Tram). Both were found guilty of corruption and enriched themselves in collaboration with three former Jiwasraya officials worth Rp. 16 trillion and money laundering (TPPU).
In this case, both were declared to have violated Article 2 paragraph 1 in conjunction with Article 18 paragraph (1) letter b, paragraph (2) and paragraph (3) of Law No. 31 of 1999 on Eradication of Criminal Offenses as amended by Law No. 20 of 2001 on Amendments to Law No. 31 of 1999 on Eradication of Corruption in conjunction with Article 55 paragraph (1) 1st of the Criminal Code.
In addition, both of them violated Article 3 of Law No. 8/2010 concerning the Prevention and Eradication of the Crime of Money Laundering.
