President of the Confederation of Indonesian Trade Unions (KSPI) Said Iqbal openly admitted to being betrayed by the government in the discussion of Omnibus Law Cipta Kerja.
“Even if we entered the drafting team, we felt betrayed. Some articles which he said returned to Law Number 13 of 2003 were not successfully included and were even left the same as the government’s draft,” Iqbal said in a press statement which was conducted virtually, Monday (12/10) ).
Feeling betrayed, said Iqbal, his party asked the executive government to carry out an executive review which invalidated the law by issuing a Presidential Regulation in Lieu of a Law (Perppu).
Iqbal said, this step could be a glimmer of hope for workers who feel they have been betrayed by the deliberation of the Ciptaker Law.
“Until the work creation law has not been promulgated, we ask the President with all respect to use an executive review, then also to the DPR leadership to use the legislative review right. That can be done,” he explained.
“If the executive reviews the form of the Perppu, but we respect the president’s consideration of the Perppu even though we hope it will be done,” he continued.
Iqbal also asked the House of Representatives to use a legislative review to double-check the Law which was deemed to be detrimental to the workers. This needs to be taken before the bill is passed and applies to all workers.
“Then the DPR, if it is the representative of the people, not only the representatives of the party, let alone the representatives of the government, will use the legislative review, which is to test the existing legislation,” he said.
In his statement, Iqbal straightened a number of things. First, he questioned the protection for contract employees who are threatened with the status of a lifetime contract. Second, the Job Loss Guarantee fund.
Third, regarding severance pay for workers who are terminated from work. Finally, the clause on determining the Minimum Wage for City and Regency which is considered irrelevant.
The plan is for the workers to return to the streets and demonstrate. However, Iqbal has not explained with certainty and clearly when the action was launched.
“And the option of carrying out a campaign and socialization for later when we accept the draft, he said, no longer, he said. Then we pair it with Law number 13 later we will socialize it,” he concluded.
KSPI’s statement is different from the attitude of the United BUMN Workers Union Forum. Secretary General of the United FSP BUMN Tri Sasono said the Ciptaker Omnibus Law did not harm workers
He said, the United State-Owned Enterprise Workers Union Federation, the Indonesian Port Workers Union Association, the Indonesian Plantation Workers Union Federation, the National Coalition for Indonesian Trade Unions, the Independent Workers Union Federation have read and studied article by article the Ciptaker Law for labor clusters related to the welfare of Workers.
“That the rules regarding the minimum wage for workers in the Employment Act (Ciptaker Act) have not been abolished. The minimum wage has not been abolished but the calculation remains to consider economic growth and inflation.
Regarding the rights of dismissed workers, said Tri, to get severance pay, the Ciptaker Law also regulates severance pay, namely the certainty of severance pay and even workers / workers who are laid off will receive additional job loss benefits (JKP).
“In addition, workers who are laid off will also get competency improvement facilities or upskilling and are given access to new jobs from the government,” he said.
Tri asks workers and workers not to be easily provoked by issues of the CIPTaker Law related to manpower issues that do not match its contents with the Ciptaker Law which has been ratified by the Indonesian Parliament.
