Law on impunity for officials withdrawn. Zbigniew Ziobro, thank you

The Marshal of the Sejm, Elżbieta Witek, announced just before 9 p.m. that the draft amendment concerning liability for violating official duties in counteracting the epidemic was withdrawn from the order of Thursday voting. Earlier, Ryszard Terlecki, the head of the PiS club, announced his resignation. “Equality before the law is a key value for our camp” – commented Zbigniew Ziobro on this decision. Earlier, the head of Solidarna Polska announced that his party, a coalition partner of PiS, would not vote in favor of this project in the form in which it was originally presented.

On Wednesday, the second reading of the draft amendment to the covid act, otherwise known as the Act on the Impunity of Officials, was held in the Sejm, the aim of which was to introduce a solution that would not criminalize an act consisting in violation of official duties or other regulations by a person acting to prevent and combat COVID – 19.

Justice Minister Zbigniew Ziobro announced at a press conference on Thursday that Solidarna Polska will not vote for this project “in the form in which it is presented at the moment”. Earlier, an activist of Solidarity Poland, Deputy Minister of Climate, Jacek Ozdoba, stressed that the law “in its original form is unacceptable”.

Terlecki: we are withdrawing now, we will definitely come back to it

On the same day, the Deputy Speaker of the Sejm and the head of the Law and Justice club announced in the Sejm that the draft amendment to the covid act would be withdrawn. – In this situation, we will withdraw it, because you can see what the votes are like at the moment. We will come back to it for sure – he said, addressing the journalists.

Terlecki later confirmed that a motion would be made at the Seniors’ Convention to remove the draft novel from the voting agenda.

Just before 9 p.m., the Marshal of the Sejm, Elżbieta Witek, informed during the meeting that the act had been withdrawn from the voting order.

Ziobro: I believe we will not stray from the bold reform agenda

Zbigniew Ziobro thanked the politicians of Law and Justice for this decision on Twitter. “Equality before the law is a key value for our camp. As the United Right, we have a bold plan to reform the state, I believe that we will not deviate from this path,” he wrote.

In mid-August, PiS deputies submitted to the Sejm draft act amending the act on special solutions related to the prevention, counteraction and combating of COVID-19, other infectious diseases and emergencies caused by them.

The draft to the act of March 2 introduces, inter alia, Art. 10 d, whose original version read: “He does not commit a crime, who, in order to counteract COVID-19, violates his official duties or applicable regulations, if he acts in the public interest and without violating these obligations or regulations, the action taken would not be possible or would be significantly impeded”.

On Wednesday, the Parliamentary Public Finance Committee gave a negative opinion on the requests of the Civic Coalition, the Left, the Polish Coalition and the Confederation to reject the draft amendment of the so-called covid act. At the same time, she gave a positive opinion, among others amendment modifying the provision on the liability of officials.

Art. 10d. Does not commit a crime (…) who during the period of an epidemic threat or state of an epidemic announced due to COVID-19, acting in order to counteract COVID-19, violates official duties or applicable regulations, if without committing these violations the actions taken could not be realized or would be significantly threatened, and the consecrated good presents a value lower than the rescued good.
