Prague All three domestic mobile operators have already officially challenged the terms of the frequency auction for fast 5G networks. Following O2, which lodged a complaint with the European Commission in July, both the Czech Telecommunications Office (ČTÚ) sued Vodafone and T-Mobile before the Municipal Court in Prague.
According to the operators, the conditions of competition are discriminatory, especially in the area of national roaming, they are also bothered by the small maximum frequency allocation in the band 3.4 to 3.6 GHz, which is the lowest in Europe and does not allow gigabit speeds. The CTU revised the conditions of the auction three times, but mostly did not take into account the objections of the companies. At the beginning of August, he announced an auction, according to him, the goal is to bring a fourth operator that would stir up the market and help reduce mobile data prices. However, according to T-Mobile spokesman Jiří Janeček, the conditions of the auction are not in accordance with the law and European regulations. “These are primarily two main contradictions with the rules in force. Firstly, with the rules on state aid and secondly with the rules of the EU regulatory framework for electronic communications (telecommunications). That is why we have turned to the courts and we will soon turn to the European Commission, “he said.
In a complaint to the EC, O2 stated that the conditions of the competition do not comply with European standards and are in conflict with national and EU legislation. “We are also preparing further legal steps, including lawsuits,” said O2 Farana Head of Communications Hana Farghali.
Vodafone, which the court recently ruled in another dispute with the CTU over frequencies for LTE networks, is convinced that the Office is acting illegally by announcing the auction and is exceeding its powers. “We are convinced that the conditions of the current 5G auction, which the CTU announced on August 7, violate EU law and national law in an even more serious way and in a broader area than the one addressed in the said judgment. We have expressed this several times in our comments, which the CTU has repeatedly rejected and not accepted. Therefore, we can only demand compliance with regulatory rules in court. We have already taken the first legal steps and we have disputed the conditions of the auction both with the CTU and with a lawsuit before the Municipal Court in Prague. According to preliminary statements, other bidders intend to enter the auction, including ČEZ, Sazka Mobil, Poda and Nordic Telecom. “We are dealing with the conditions of the announced frequency auction, but so far we will not comment publicly on our progress in this matter,” said Nordic Telecom spokesman Lukáš Šiml.
In the auction, the CTU will offer frequencies in the 700 MHz band released after the transition of TV broadcasting to DVB-T2 and then the 3.4-3.6 MHz band. The bidding part itself should take place in the autumn. 5G networks are intended to offer new services requiring high speed and very short response. Speeds should exceed ten times the current LTE technology.

Existing operators are already testing 5G. O2 launched a commercial 5G in Prague and Kolín in the summer, Vodafone is preparing to do so in five cities in October, and T-Mobile will test 5G on the VŠB campus in Ostrava.
