Justice Department lawyer Brad Rosenberg wrote in court documents that “substantial past evidence shows that children of nonresident aliens are subject to the jurisdiction of foreign governments and therefore are not subject to U.S. jurisdiction, are not constitutional, and are not entitled to citizenship.”
Lawyers representing four states pointed out that the Constitution does not give the president, federal agencies or others any authority to impose conditions on the citizenship rights of people born in the United States.
The plaintiffs’ legal team pointed out that without the temporary restraining order, children born in the four states will soon become undocumented persons and will face the risk of deportation or detention. They will even become stateless and will be deprived of their freedom to travel and re-enter.The right to enter the United States and will lose the ability to obtain a Social Security number (SSN) and work legally while growing up.
