United States President-elect Donald Trump would have been convicted of trying to overturn the 2020 election had he not won the election four years later, according to a report by special counsel Jack Smith published today by US media information.
“The evidence was sufficient to convict,” said the report by special prosecutor Jack Smith, according to the BBC. The 137-page document was sent to Congress after Judge Eileen Cannon cleared the way for the release of the first of two parts of Smith’s report into the election-meddling case.
In the meantime, he ordered a hearing later this week on whether to release the portion of the report on allegations that Trump illegally kept classified government documents. It is also noted that the special prosecutor, Jack Smith, resigned from his position last week. Smith was appointed in 2022 to oversee the US Justice Department’s investigations into Trump when he takes office on January 20.
Trump has been accused of keeping illegal documents and, in some cases, storing them in rooms at the Mar-a-Lago resort in Florida, where he owns the residence. In the 2020 election meddling case, he was charged with conspiring to overturn the election result then. Both cases resulted in criminal charges against Trump, who has pleaded not guilty, calling the prosecutions politically motivated.
But Smith closed the cases after Trump’s election in November, under Justice Department regulations barring the prosecution of a sitting president. Indeed, in the released report, Smith states: “The Justice Department’s view is that the Constitution prohibits impeachment of a president.”
