Van Thinh Phat Case: Appeal Focuses on Financial Penalties, Fate of Project 6A Unclear
In a landmark ruling, the High People’s Court in Ho Chi Minh City has issued final verdicts regarding the Van Thinh Phat case. Defendant Truong My Lan, facing accusations of property damage, bribery, and fraudulent lending practices, was sentenced to death.
The court ordered Lan to compensate Saigon Commercial Bank (SCB) for an astounding $28 billion VND (approximately $1.18 billion) representing unpaid loans. This immense sum reflects the devastating financial fallout of the case.
Beyond the dramatic sentencing, the court’s decision left unanswered questions about the fate of Project 6A, a 26.4 hectares real estate development in Binh Chanh district.
SCB had requested control of project 6A, citing its value as collateral for the millions in outstanding loans. However, the appeals court ruled that the project’s fate was not within its purview.
"The content related to the 6A project was not evaluated and resolved by the first judgment, so it is not within the scope of the trial by the Court of Appeal," the court stated.
Adding to the complexity, Lan, during her appeal, called for SCB to return all legal documents pertaining to Project 6A, pledging to voluntarily cede the property for debt recovery. This move further muddies the water surrounding the project’s future.
The court acknowledged Lan’s substantial financial liabilities in the case. Any assets connected to her will be subject to requisition for debt repayment, according to established legal procedures in Vietnam.
This judgment marks a significant development in the Van Thinh Phat case, punctuated by severe personal penalties and a hefty financial burden. However, the future of valuable Project 6A remains unresolved, potentially setting the stage for further legal battles.
