Special session jumpstarts effort to safeguard Californians from potential federal overreach

California Gearing Up for Potential Legal Battles with Incoming Administration

California Governor Gavin Newsom is preparing for potential legal clashes with the incoming presidential administration by proposing a $25 million litigation fund. This proactive measure aims to safeguard the state’s interests and protect crucial funding for essential services.

During the previous Trump administration, California experienced numerous disagreements with federal policies, resulting in over 120 lawsuits filed by the state’s Department of Justice. These legal battles, while costly, proved fruitful in many instances. One successful case saw California receive nearly $60 million in federal public safety grants. Another victory, which delayed energy efficiency standards proposed by the Trump administration, is projected to save California consumers over $8 billion in energy costs over the next three decades.

"The Governor’s proposed legal investment has the potential to yield significant returns for California families and protect billions of dollars in state funding," a statement from the Governor’s office read.

The new litigation fund would provide the resources necessary for California to defend against anticipated federal overreach and challenge potentially harmful actions in court. It underscores the state’s commitment to upholding its values and protecting vital programs such as disaster relief, health care, and other services relied upon by millions.

Beyond the financial implications, the litigation fund is aimed at safeguarding fundamental rights and protections for Californians.

“During President-elect Trump’s first term, his administration made multiple attempts to withhold federal funds from California and harm the state.”

The Governor, while prepared to take legal action when necessary, remains hopeful for collaboration with the new administration.

“While the state is prepared to lead efforts to challenge any unlawful actions by the federal government, Governor Newsom is committed to working with President-elect Trump wherever there is common ground to improve the lives of nearly 40 million Californians,” a statement from the Governor’s office said.

In November, Newsom traveled to Washington, D.C., to advocate for several key initiatives, including improvements to healthcare, mental health services, and cleaner air. He hopes to build on this groundwork to secure federal support for California’s needs.

The proposed legislation for the litigation fund is expected to be introduced in the state Legislature shortly. Public hearings are anticipated in the coming weeks, followed by refinements and advancement of the measure toward the Governor’s desk for signature before January 20, 2025.
