Court opens three more files for violation of suspensions against judicial reform

Mexico City. The Supreme Court of Justice of the Nation (SCJN) opened three new files this Thursday in which the Council of the Federal Judiciary (CJF) and the Electoral Tribunal of the Judicial Power of the Federation (TEPJF) are accused of not abiding by the suspensions issued by federal judges against judicial reform, among them those ordering to stop the process of extraordinary election of judges, magistrates and ministers in 2025.

The three appeals were promoted by judges and magistrates based on article 11, section XVII of the Organic Law of the PJF, which empowers the Plenary Court to “know and settle any controversy that arises” between the organs of that Power.

Two of the files were handed over by Minister President Norma Lucía Piña Hernández to Minister Javier Laynez Potisek. One was promoted by magistrates and judges of the Third and Twentieth Circuit against the CJF for having delivered to the Senate of the Republic the lists of the members of the PJF to continue the judicial election process, “contravening various judicial orders issued by judicial bodies that exercise the power of the federation.

The second, promoted by the national director of the National Association of Circuit Magistrates and District Judges of the PJF (Jufed), Juana Fuentes Velázquez, accuses the violation of the precautionary measures issued by various judges against the judicial reform published on September 15 past.

“I believe that certainty, legal security and due process in the constitutional order of the Republic are at stake.”

The third controversy promoted by judges and magistrates of the Third Circuit was turned over to Minister Alfredo Gutiérrez Ortiz Mena against the decision of the TEPJF taken on October 23 that declared that “it is constitutionally infeasible to suspend acts that are related to the development of the procedures electoral process in charge of this authority, regarding the Extraordinary Electoral Process of the Judicial Branch of the Federation (PEEPJF) 2024-2025.”

Last week, Minister Piña also opened other files in which judges ask the Court to clarify which body is competent to hear the suspensions that order to stop the judicial reform, matters also referred to Gutiérrez Ortiz Mena.
