Anti-immigrant laws in North Carolina: All the details of the HB 10 law | USA

Starting December 1, 2024a new law aimed at restricting the rights and mobility of immigrants will come into force in the state of North Carolina. It is known as the ley HB 10 and has received a series of criticisms for how aggressive it could be for this group of people in certain contexts.

One goal is to force the state’s prisons to cooperate with Immigration and Customs Enforcement (ICE). USA to verify the immigration status of people arrested for certain crimes.

These are the crimes that HB 10 will activate

If any authority is suspected of any of the following crimes, they will have to verify your immigration status.

  • Serious crimes such as homicide, rape, and related offenses such as sexual activity with a student or sexual offense with a child by an adult.
  • A Class A1 misdemeanor or felony: assault.
  • Any violation of GS 50-B-4.1: violations of valid protective orders.

In this way the status of an immigrant will be verified

  • With a document that proves it such as a driver’s license, visa, among others).
  • With an investigation of the detainee.

If it is determined that the person is undocumented, ICE will issue a detention order and an administrative order for the detainee. The person may remain in jail for up to 48 hours waiting for ICE to arrive to take them into custody.
