Anger is brewing among parents of students in La Ciotat, in Bouches-du-Rhône. According to information from the Marseille prosecutor’s office, questioned by our colleagues from Parisian and confirming information of BFMTVa petition was launched to request the exclusion of a 9-year-old student from Louis Vignol primary school.
The little boy is accused of having sexually assaulted one of his classmates in the establishment’s toilets.
An investigation has been opened
The events allegedly took place on November 14. The victim, aged 8 and in CE2 class, told his parents that he had been the victim of forced touching by another student, aged 9. The little boy’s parents first informed the school management, before filing a complaint. The primary school also sent a report to the Marseille prosecutor’s office.
This first complaint, however, would have opened the floodgates, according to information from the Parisian. Our colleagues indeed affirm that several children have reported having also been victims of forced touching, by the same little boy. So much so that some parents preferred to temporarily withdraw their child from school, as a preventative measure.
A petition was also launched by the parents of the students, who demanded the “immediate exclusion” of the accused student. “We, parents of students at École Louis Vignol, are deeply concerned and outraged by the serious acts of physical and sexual violence perpetrated by a student within the establishment.”
A child considered “non-discerning”
The Marseille prosecutor’s office specifies that the child accused of sexual violence against his comrades is presumed “not discerning.”
“In principle, a minor under the age of 13 cannot be prosecuted. The law presumes that he or she is not capable of accurately assessing a situation. We are talking about the presumption of indiscrimination.” recalls the site of Service Public. “So that the prosecutor can pronounce an alternative measure to prosecution (that is to say a measure which prevents the minor from being judged but which makes him aware that he has committed an act prohibited by law), The investigation must then have demonstrated that the minor meets the following 3 conditions: he is able to understand what he did, he had the intention, and he understands the meaning of the procedure to which he is subject. “
According to Jean-Louis Tixier, deputy for Education at the town hall of La Ciotat, the accused child has now been temporarily excluded from school: “The academy must make a definitive decision so that this student no longer returns, but also most certainly to reorient it,” he said.
