Anm to the government: “Exposing immigration judges distorts the system”. Wrath of the League

“With a stroke of the pen we would like to overturn the ordinary structure of competences. The Court of Appeal – already burdened with important workloads which have made us doubt the possibility of achieving the ambitious objectives of the Pnrr – should deal with the validation procedures, if I didn’t misread it even with its criminal sections. It is very difficult to find a principle of rationality in this distortion of the order of competences”. This was stated by the president of the National Magistrates Association, Giuseppe Santaluciain his report to the Central Steering Committee of the ANM underway in Rome. The reference is to the amendment to the flows decree, according to which the competence to decide on the validation of detentions should be ‘moved’ to the Court of Appeal.

For Santalucia the amendment is “aimed at stripping the specialized ‘immigration’ sections of the Courts of competence over the validation of detentions, with gentle and surprising indifference to the reasons for judicial organisation”. According to the president of the ANM, “it is very difficult to find a principle of rationality in this distortion of the order of competences”.

“We perceive rather – he added – the desire to represent in the most blatant way, precisely, with the removal of competence, the mistrust in the jurisdiction, starting from the imaginative belief that the communist magistrates have treacherously placed themselves in the specialized “immigration” sections of the Courts to carry out sabotage of government policies”.

Assembly, reforms and constitutional structure

The central steering committee of the ANM today unanimously approved the calling of a general assembly of the National Association of Magistrates on the topic of “reforms and constitutional structure of the judiciary”. The meeting will take place on January 12th.
