Berlin – A student has to leave school after a hacker attack on data from a Berlin high school. The Berlin Administrative Court decided this and thus confirmed a decision by the Senate Education Administration in an expedited procedure, as a spokesman announced. (Af.: VG 3 L 610.24)
From the court’s point of view, the measure is proportionate, even though the person concerned is in his last school year before graduating from high school and the first high school exams are due in just a few months. The judges cited the student as being completely unreasonable. An appeal against the decision can be lodged with the Berlin-Brandenburg Higher Administrative Court.
High school data spied on
According to the court, the high school student and two classmates prepared a school computer so that the next password entered was logged. The trio obtained the administrator password and then installed a “keylogger” that made it possible to log all entered passwords. According to the court, this allowed the students to read internal information in the protected teacher channel and access organizational data from the school management.
After the matter was discovered, the Senate Education Administration, as the school supervisor, decided to transfer the high school student to another school. The young man defended himself against this in court – without success. From the judge’s point of view, the most serious regulatory measure in the Berlin school law is appropriate in the case.
