A BGNES check on the portal of the Public Procurement Agency found that the mother of a deputy from GERB commissioned the preparation of a legal analysis to the father of a deputy from the Reform Bloc for BGN 100,000. The assignment of the service, regardless of the fact that it refers to funds from the budget of the Metropolitan Municipality, would hardly have raised questions if the contract had been made through a won public contract, and not through direct negotiation.
On March 16, 2015 at 2:32 p.m. the Deputy Mayor for “Legality, Coordination and Control” of the Metropolitan Municipality, Yulia Nenkova, approves the conduct of a procedure for “negotiation without notice” for the preparation of “Legal analysis of the current and repealed legal framework, concerning the activity of implementing projects for the construction of MVPP, as well as a legal analysis of all the available documentation available to the CO and which is relevant to the realization of the MVPP”. The municipality motivates the need for the preparation of the legal analysis by an external company with the lack of “necessary experts possessing knowledge and competence in the given field”. On the basis of several texts from the Civil Procedure Code, a legal way was found to assign the analysis not through a competition, but through direct negotiation. This allows an invitation to be sent only to “Eurolex Bulgaria” OOD, in which the managing partner and founder is Andrey Delchev. The estimated value announced in the invitation is BGN 90,000. (without VAT) or BGN 108,000, including VAT. The deadline for submitting documents is from 4:00 p.m. on March 16 to 10:00 a.m. on March 18. As early as March 17, 2015. at 1:46 p.m. all the necessary documents required by “Eurolex Bulgaria” Ltd. have been submitted to the Metropolitan Municipality.
On March 21, 2015 (working Saturday – note.) a five-member commission from the Council of Ministers, led by Kalina Borisova, chief legal advisor in the Public Procurement Directorate, prepares a report stating that the necessary agreements have been reached with the only invited candidate, and the relevant documents have been signed protocols. The Commission proposes to the Mayor of the Capital City Municipality (Yordanka Fandakova – editor’s note) to assign the preparation of the legal analysis for the construction of the MVPP.
On March 24, 2015, the report of the five-member commission gave reason to the deputy mayor Yulia Nenkova to issue the Order of the Council of Ministers 15-RD-09-02-79/24.03.15, with which the performance of the assignment was assigned to the pre-selected candidate – the company “Eurolex Bulgaria”.
Additional inquiries on the website of the SO and “Eurolex Bulgaria” show that Nenkova and Delchev have long-standing professional cooperation. It turns out that while Nenkova goes through all the stages of professional growth as a lawyer in the municipality, the office of Delchev is among the preferred legal consultants of the Sofia City Hall.
Yulia Nenkova is one of the eight deputy mayors of Sofia Municipality. He has been in his current position since 2006. (at that time, the mayor of Sofia was Boyko Borisov – note ed.). A reference on the website of the municipality shows that Nenkova joined the Sofia City Hall as early as 1980. Julia Nenkova is the wife of the constitutional judge Rumen Nenkov.
Andrey Delchev founded “Eurolex Bulgaria” in 1997. having previously been Head of the Legal Department of the Council of Ministers under seven governments for more than 6 years. From a reference on the website of Delchev’s office, it is clear that it is among the preferred partners of the Metropolitan Municipality when it comes to awarding concessions. The office is a consultant to the municipality under the mayor Stefan Sofianski in the preparation of the capital’s water concession. The portfolio of “Eurolex Bulgaria” includes the provision of consultations for: concession under the B-O-T model of 7 hydroelectric facilities connected to the capital’s water supply system; lighting renovation project in Sofia; the construction of the second metrodiameter; the concession of the Central Mineral Bath, the construction of the now defunct shopping center at the Central Station and others. Andrey Delchev is also the executive director of the Bulgarian Oil and Gas Association, whose chairman is Valentin Zlatev, general director of Lukoil Bulgaria.
Since November 2014, in addition to a professional nature, the acquaintance between Nenkova and Delchev already has a coalition dimension. The son of the deputy mayor of Sofia, Yulia Nenkova – Alexander Nenkov, is a GERB deputy in the third parliament in a row. The son of the municipality’s legal consultant for the analysis of the practice in the construction of MVPP Andrey Delchev – Dimitar Delchev, is a member of the Reform Bloc in the current National Assembly. The procedure carried out in this way for the preparation of a legal analysis puts MPs Nenkov and Delchev in a delicate position and in view of the coalition agreement between GERB and RB signed on November 6, 2014, in which the two parties undertake to prevent “…the growth of economic, political and judicial power against the interest of citizens…”.
BGNES recalls that already in 2012 the capital’s mayor Yordanka Fandakova announced the municipality’s intentions until 2020. Sofia to build 8 small hydroelectric plants with a total value of over BGN 20 million. The chief architect of Sofia, Petar Dikov, optimistically predicts that the announcement of the tenders for the selection of the MWEP builder is a matter of recent decision. Three years later, no such procurements have been announced. The obvious desire of the municipality that the preparation of the legal analysis for the construction of an MVPP be carried out by a certain contractor raises additional questions, among which are: what will be the real benefits for the people of Sofia and what will be the price of each of the future MVPP, which will eventually are being built. By the way, already years ago, the concessionaire “Sofijska voda” prepared a list of the most suitable places for the construction of the MVPP:
