Autonomy: tomorrow the Council will decide on appeals from 4 Regions

(ANSA) – ROME, NOV 11 – Tomorrow the Council will address the constitutionality issues regarding the law on differentiated autonomy raised with the appeals of the Puglia, Tuscany, Sardinia and Campania Regions, which have challenged the law in its entirety and also with reference to specific provisions. The questions submitted to the Court for examination are linked to the interpretation of article 116 in relation to the attribution to the regions of further forms and particular conditions of autonomy. Some of the issues concern the determination of the LEP (essential levels of performance concerning civil and social rights which must be guaranteed throughout the national territory) both with regard to the source and procedure of determination, and with regard to the identification of the subjects and for the transfer of functions. Other issues concern the procedure for approving agreements between the State and the region for the attribution of matters and related functions. Still others involve the methods of financing the transferred functions. The Regions of Piedmont, Veneto and Lombardy intervene in opposition in some of the proceedings. The Court will decide on the admissibility of their interventions. (HANDLE).
