(Seoul = Yonhap News) Reporter Lee Chung-won = Former Chairman of the Board of Audit and Inspection Lee Si-yoon, who was a leading figure in domestic civil procedure law and civil execution law, had a great influence on the civil law academic community as a whole, and contributed greatly to establishing the theoretical framework of the Constitutional Court as an early Constitutional Court judge, on the 9th. Upon his death, legal professionals expressed their condolences by posting memories of the deceased’s book ‘Civil Procedure Act’ (later renamed ‘New Civil Procedure Act’) and lectures on Facebook.

Park Chan-woon, a professor at Hanyang University Law School, wrote, “The deceased was the founder of civil litigation law in Korea,” and added, “I think the passing of Professor Lee Si-yoon is my final farewell to a teacher born in the 1930s.” The following is a summary of the condolences posted on Facebook by legal figures. (Names are in alphabetical order)

▲ Kim Cheol-joong, Adjunct Professor, Department of Real Estate, Dongguk University = I have been with the Korean Civil Enforcement Law Association for a long time, and learned the true value of knowledge and law by listening to the professor’s lectures while preparing for the bar exam. His warm teachings and advice were a great help to me, and the friendly conversations we had together will always remain as precious memories of my life. The professor contributed greatly to the development of civil procedure law and civil execution law, and his deep academic passion and dedication served as a role model for many of his students.

▲ Attorney Park Jong-heun = I also studied civil procedure law with Professor Lee Si-yoon’s book, and also lectured on civil procedure law to students preparing for the second round of the bar exam at Hallym Law Academy. I still refer to this professor’s book from time to time. Also, when the professor was an advisor at Chunghyun Law Firm, I went on a practical training trip and used the professor’s room. Our legal science has developed thanks to great professors like Professor Si-yoon Lee. I hope that in the future, more legal scholars will follow in his footsteps and our jurisprudence will develop further.

▲ Professor Park Chan-woon, Hanyang University Law School = The deceased is someone who can be called the founder of Korean civil litigation law. While working as a legal practitioner, he studied civil procedure law in depth and had a significant impact not only on practitioners but also on academia. It is no exaggeration to say that Korea’s civil litigation law is divided into before and after, starting with Lee Si-yoon. When I was in college, I studied civil procedure law using your book and even had the opportunity to take a semester-long lecture.

I passed the exam and threw away most of the books I used during the exam, but I saved a few books. One of them is your book. Even now, that book is on the shelf in my lab, and I show it to students who are starting their law studies and talk about the study attitude of law students. Some of the teachers who taught law when I was a student were born in the 1920s, but most of them were born in the 1930s. Among these people, the teacher born in the 1920s passed away a long time ago, and the teachers born in the 1930s passed away one by one over the past 10 years, so almost none of them are alive anymore. I think that Teacher Lee Si-yoon’s passing is my last farewell to a teacher born in the 1930s.

▲ Professor Shin Bong-gi, Kyungpook National University Law School = I studied with Professor Lee Si-yoon’s book on civil procedure law, and after studying abroad in Germany, I returned to Korea in 1989 and started my first job as a public official at the Constitutional Court thanks to my relationship with Justice Lee Si-yoon. I was part of Judge Lee’s designated court and personally served him for several years. The unconstitutionality of the International Group disbandment case, in which I also participated and ruled during the case presided over by Justice Si-yoon Lee, is still an honorable and meaningful memory for me.

When I first entered the Constitutional Court, he personally scolded me and taught me the practical skills of a trial (constitutional trial), as I had only been studying. When I received an order to review a case and brought the review report, sometimes he would throw it on the floor and yell at me, asking if this was a review report. I studied while holding back tears. Even more after returning home. Time passed and now I am one year away from retirement age. Professor Si-yoon Lee, Judge Si-yoon Lee, Chairman of the Board of Audit and Inspection Si-yoon Lee, and academic advisor Si-yoon Lee, who were a great help to my growth… It’s been several years since I last saw you. My heart aches.

▲ Jinsoo Yoon, professor emeritus at Seoul National University Law School = Professor Siyoon Lee has passed away. He greatly developed civil litigation jurisprudence in our country, and as a Constitutional Court judge, he also contributed greatly to establishing the framework of the constitutional trial system. I took his lectures in college, was his advisor for a short period at the Judicial Research and Training Institute, and was personally appointed as a researcher at the Constitutional Court. I called you a while ago and said you would come see me, but you refused, saying it would be difficult to meet. I wonder if you should have gone out of your way to come see me.

▲ Attorney Lee Hyeon-gon = When I first studied law, Lee Si-yoon’s ‘New Civil Litigation Act’ seemed like an impregnable fortress. If something happens, it means that the book was not read well and progress was not made. Later, after accumulating a certain amount of knowledge, I read it and realized that it was a really well-written book with no unnecessary details. It was a book in which the contents were condensed to a great extent without wasting a single word or topic. However, I do not recommend this book to beginners. I think a book should have some unnecessary elements and some rest areas. Doesn’t that make the bookshelf fall over? I think it will be difficult to come across a book like this before or after.
