Coordinating Minister for Law, Human Rights, Immigration and Corrections Yusril Ihza Mahendra President Prabowo Subianto explained that the President will not withdraw the name of the KPK (Capim) leadership candidate who was elected as a result of the election committee established during the 7th President Joko Widodo (Jokowi) . Yusril calls this a middle way.
“This is a moderate way until Article 30 of the Corruption Eradication Committee law is complied with and the decision of the Constitutional Court is also complied with,” Yusril said in a written statement, Friday (8/11 /2024).
He said Prabowo was taking the middle path to prevent a vacuum in the KPK leadership. The term of office of the current KPK leadership will expire in December 2024.

Yusril said the government is aware that Article 30 of the Corruption Eradication Committee Law makes the selection process for KPK leaders about 6-6 months. Yusril said that the leadership of the DPR RI had sent a letter to President Prabowo, basically asking whether the names of the candidates proposed during Jokowi’s time would be withdrawn or not. President Prabowo, according to Yusril, has answered the letter of the DPR and stated that he agrees with the names of the KPK Capim and Cadevas.
“God willing, this middle way can overcome a potential void in the KPK leadership that will expire at the end of December next year,” he said.
Before that, the Pansel KPK Capim that was created in Jokowi’s time had completed its work and produced 10 names of KPK capims and 10 KPK cadwas. After taking the official post as Coordinating Minister, Yusril said the government would look again at the Constitutional Court’s decision regarding the term of office of the KPK leadership which also included the issue of ‘ formation of a committee for KPK leaders. Yusril said the government would also coordinate with the DPR.
“Regarding the issue with Pansel KPK raised by President Jokowi some time ago, we are currently investigating this issue and carefully reading the latest MK decision,” Yusril said at Presidential Palace complex, Jakarta, Tuesday (22/10).
“That application was submitted only once by the president in connection with the extension of the term of office of the KPK leadership from 4 years to 5 years,” Yusril continued.
For information, the Constitutional Court gave the case of the Deputy Chairman of the KPK, Nurul Ghufron, which then changed the term of office of the leadership of the KPK from 4 years to 5 years. The change in the term of office is announced in the Decision of the Constitutional Court Number 112/PUU-XX/2022.
In its decision, the Constitutional Court said that the authority of the president and the DPR to hold two elections during the term in office had the potential to affect the independence and psychological state of the KPK leadership. The Constitutional Court then gave an example of the president elected in 2019 who could make two elections for the leadership of KPK, that is in 2019 and 2023, if the time for the leadership of KPK remains 4 years.
According to the MK, this will not happen again if the term of office of the KPK leadership is changed to 5 years. The Constitutional Court said that changing the term of office of KPK leaders to 5 years means that the election or appointment of KPK leaders for the next term will be done by the president and the DPR for the period 2024-2029 .
State Minister Prasetyo Hadi then said that Prabowo would not review the names of the top KPK leaders and cadwas. He said the captains made by the Jokowi era selection committee are also the best people.
“I don’t think so,” Prasetyo told reporters at the Presidential Palace building, Jakarta, on Wednesday (6/11). Prasteyo replied that the government would review the names of top KPK leaders and cadwas. This is because the DPR has sent a letter to the President regarding the names of the top KPK leaders and cadwas.
“The process is already underway, according to procedures, and our way of thinking is that we do not want to waste energy, in fact it is those that were produced at that time the best recommended people. In principle, President Prabowo follows what the former President suggested,” he continued.
