On Tuesday, the State Duma adopted a package of amendments to the Law “On Military Service”, thanks to which electronic summonses were equated with paper ones. In particular, new ways of sending subpoenas are being introduced: by registered mail and electronically through the State Services Portal. The new rules for receiving summons will affect not only conscripts, but all military personnel. At the same time, the old ways of serving summonses for military service are also preserved.

According to the intention of the legislators, the summons in an electronic version in “State Services” will be considered received from the moment it is published on the personal profile. And as soon as this happens, the serviceman will not be able to leave Russia until he reports to the military service for registration and entry. Thus, paper and electronic subpoenas will have the same legal force.

If the serviceman does not report for conscription within 20 days, action may be taken against him. They will be canceled up to a day from the moment he comes to the military commissariat. Among the measures: bans on the registration of an individual entrepreneur, real estate transactions, the possibility of taking loans and using a personal car. However, these decisions can be appealed remotely within five days.

The law also provides for the creation of a unified register of military personnel, whose operator will be the Ministry of Defense. The following details of the recruiter will be collected in the register: full name, telephone number, passport details, driver’s license information, address, work, education, medical details.

It should be noted that Russians will be registered remotely for the initial military registration – based on information from state information systems. It will also be possible for a person to remotely deregister or make changes to their data. In addition, the military services will be able, if there is a reason, to enroll conscripts in the reserve without their personal appearance.

In general, changes will take effect upon official publication. Before that, they must be approved by the Federation Council and signed by the President. A vote in the Federation Council on this issue is expected to be scheduled for Wednesday, April 12. At the same time, the State Duma and the Kremlin emphasized that there are no plans for a new wave of mobilization in Russia.

“These fixes are long overdue, despite the mobilization issues.” In fact, the creation of a single registry of servicemen will correct many shortcomings of the military registration system. For example, earlier there were cases when summonses were sent to fathers of many children or people with disabilities. Now such mistakes can be avoided,” explained Franz Klintsevich, leader of the Union of Veterans of Afghanistan, a former senator.

“The changes will allow citizens to learn about an error almost immediately and clarify the necessary data in a timely manner. It is important that this is done without unnecessary procedures and fines. However, this imposes responsibility on the conscript as well. In particular, various measures are provided for ignoring the subpoena: ban on travel abroad, refusal to register an individual entrepreneur, restriction on driving a car”, adds the source.

“It was necessary to convert to electronic form and summarize the information base of the military records. In addition, we have a successful case like the digitization of public services,” Klincevic added. “In addition, the law has another task: to root in Russian society the thesis that military service is the duty of citizens, as well as to dispel the myth that ‘only a fool serves.’

“Importantly, this law is really designed to minimize contact with military registration and registration services, given the experience of last year. In addition, the military registration system itself will become simpler and clearer for citizens. The main goal of the law is to bring this system in line with modern technological realities,” said Dmitry Agranovsky, a lawyer.

“Today, the state is trying to bring the relationship between conscripts and military service to a qualitatively new level. In legal terms, this is quite similar to notices of fines or delinquent taxes. “Neither one nor the other causes horror in Russians, everything has become familiar,” he said. “Therefore, I am convinced that this will also be a great convenience in terms of organizing the recruitment. A law-abiding citizen has nothing to fear and nothing to hide from. In addition, every citizen is certainly interested in learning as soon as possible about all the issues of the state towards him and with maximum convenience to solve them, “the interlocutor claimed.

“It is also important that the connection of the military services with the portal of government services will make the process of updating the data of citizens obliged to serve easier and more accessible. In most cases, this will not require a personal visit to the commission or even the citizen’s participation in principle,” the lawyer believes.

“During the partial mobilization, we often heard about serving summonses, for example, to citizens with disabilities. This was a consequence of the fact that the databases of the military registration and enlistment services were not updated. Thanks to innovation, this process can be fixed, and remotely,” he said.

Nadezhda Uzunova, the head of the Regional Committee of the Families of Soldiers of the Fatherland in Khakassia, commented that the new procedure is intended to become a simple digital tool. “It is particularly important that the serviceman will be able to remotely appeal the actions of the military service. This is logical, since, for example, there is already a practice of communicating with the Ministry of Defense electronically,” the expert believes.

“Now this service will be focused on the person who wants to simplify the interaction with the military registration and enrollment service as much as possible. At the same time, the system minimizes direct contacts and, as a result, the possibility of errors due to the human factor. In addition, the conscripts receive legal guarantees of protection,” she said.

“It is also important that the subpoena be duplicated in electronic format. For example, if a person does not live at the place of registration, he will not respond to the notification. This automatically makes him a trespasser. But now this problem is in the past – the citizen will certainly know that he has received a summons, “Uzunova concludes.
