Cor spent hours at the Jumbo center with a brain hemorrhage, the family went to court

Lorry driver Cor Hooijmans had to unload a load at the Jumbo distribution center in Den Bosch in early January. At the unloading site, near his truck, he suffered a brain hemorrhage and collapsed. Cor lay on the ground for hours before he was found. He died in hospital much later. His family are now holding Jumbo and employer Simon Loos responsible for his death.

Cor had been a truck driver for the carrier Simon Loos since 1994. He usually drove to Albert Heijn and occasionally to Jumbo. As usual, 65-year-old Cor used to load at the Jumbo in Den Bosch.

He reported the breakdown of the distribution center on Saturday January 6 at ten to six in the evening. “After that, Cor should have reported to the counter with his consignment note, but it never arrived,” said the family’s lawyer, Jan Willem Weehuizen.

Cor was found by a colleague. “That happened because he had not yet reported to his next destination. This company asked Simon Loos to ask where he was,” says Weehuizen. The closest colleague went to see where Cor. “He was found at half past nine in the evening. That’s almost four hours later. The big question is: how on earth is this possible? “

“You can compare it to Nouri’s case against Ajax.”

“The camera has a fixed place there, they’ve been watching it all along. He was lying next to his front wheel. The Jumbo says they also do tours. Even then they should have seen it,” Weehuizen explains.

So the lawyer will be liable to Jumbo. “They are responsible for the good care and safety of everyone who works there. No one else can enter that area: no one else could have seen him. Jumbo has not fulfilled its duty of care. “

According to the lawyer, Jumbo does not feel responsible. The supermarket group told the lawyer that ‘they did what they could, they did a round and they didn’t see anything’.

The employer Simon Loos can also prepare to go to court, says lawyer Weehuizen: “The law says that if something happens to you while you are doing work for your employer, that employer is responsible. You can compare it to Nouri’s case against Ajax. The Ajax player suffered serious brain damage during a match and the Amsterdam club was responsible for this.

But no word has been heard from Simon Loos yet, according to the lawyer. “I emailed them in June, July and at the end of August, but apart from a read receipt and a promise to get back to me, I haven’t heard anything substantial from them. Now the judge has to decide.”

In addition, the family and the lawyer believe that Simon Loos has not shown much concern for the remaining relatives. “There was almost no care. Simon Loos is a big company. It could at least provide relief or help. ” Instead, Cor’s widow received three monthly salaries, even though he had worked there for almost thirty years. “It’s a cold shower on the family and it comes across as very heartless.”

Ensuring compensation is the only thing the lawyer can do for the surviving relatives. “It’s a drama. Cor’s wife has not yet recovered and that is not going to happen. There are five dogs still waiting for Cor who thinks he will come home.”

After questions from Omroep Brabant, a spokesperson for Simon Loos said he “will not answer the substantive questions that have been asked” about this matter. Jumbo was also contacted, but has yet to respond.
