The government is celebrating after the financial prosecutor’s decision to lift the protection of protected witnesses, codenamed “Aikaterini Kelesi” and “Maximos Sarafis” for the Novartis scandal.
After the unprecedented decision, against the Supreme Court, the government representative states that “among the main changes proposed by the Ministry of Justice for the Code of Criminal Procedure and voted in the Hellenic Parliament in February of this year, was the amendment of article 218 for the status of witness protection and specifically the addition of paragraph 7, which is effective from May 1, 2024 and provides that: “The suitability and necessity of protection measures are constantly examined by the competent prosecutor, who may, at any time, in case they have imposed by his order to modify or revoke them or in other cases to propose their modification or revocation, when at his discretion the reasons for their imposition are varied or disappear”.
At the same time, he added that “the independent Greek Judiciary today issued a landmark decision, removing the “hoods” from the false witnesses of the Novartis scheme. Our democracy is resilient. The truth will shine.”
Stephen Cohn: “They are protected by US law and US law”
Finally, the specific decision is expected to bring the Greek justice system face to face with the American one. In particular, as he had revealed in an interview with Documento, almost five years ago, the well-known lawyer, Stephen Cohn, who represented the public interest witnesses on the other side of the Atlantic: “they are protected by American legislation and US law.”
Furthermore, he had made it clear that in the event that the Greek government attempted to reveal the names of the informants, with a request that he would file in the US, he would request “the expulsion of Greece from the OECD” and the “issuance of arrest warrants by Interpol for the arrest of Greek officials”, for “obstruction of American Justice and violation of whistleblowers’ rights”.
