The administrative court cancels the subsidy awarded by the City of Marseille to SOS Méditerranée

On February 8, 2021, the Marseille municipal council approved the signing of the charter summarizing the values, principles and missions of the actors engaged with SOS Méditerranée and awarded it a grant of 30,000 euros. Seized by a municipal councilor, the court only canceled the subsidy.

It notes, first of all, that the dispute has retained its object despite the deliberation of September 20, 2024 withdrawing the contested deliberation, this withdrawal not having a definitive character.

Then, applying the decision of May 13, 2024 of the Council of State, it notes that neither the deliberation nor the agreement relating to the payment of the subsidy indicated its destination, which did not allow the municipality to ensure that its Aid would be exclusively intended to finance international humanitarian rescue action at sea, to the exclusion of financing any other activities carried out by the association.

Finally, it rejects the conclusions directed against the approval of the signing by the City of the “charter detailing the values, principles and missions of the actors engaged with SOS Méditerranée”, the applicant not demonstrating that the municipal council would have thereby encroached illegally on the State’s conduct of France’s international relations
