Constitutional judicial reform; in contempt, Juárez Salas, says Sheinbaum

Mexico City. President Claudia Sheinbaum Pardo rejected being in contempt for the publication in the Official Gazette of the Federation (DOF) of the constitutional reform in judicial matters. On the contrary, he emphasized, “the one who is in contempt is the judge (Nancy Juárez Salas)” for violating article 61 of the protection law.

In her morning this Monday, the federal president explained that this article establishes in its first section that “the protection is inadmissible against additions and reforms to the Political Constitution of the United Mexican States.”

Faced with this, the head of the Executive questioned: “Isn’t article 61 of the protection law clear? It’s very clear! (…) It is very easy to say that the president ‘is in contempt’, no, we are not in contempt.”

He indicated that once it is notified of the resolution of Judge Juárez Salas, the Legal Department of the Federal Executive will send a question to the Congress of the Union to know if it has the power to eliminate the judicial reform from the DOF.

In recent days, Judge Juárez Salas of the Nineteenth District Court in Veracruz, granted a suspension in which she ordered President Sheinbaum to withdraw from the DOF the publication of the reform to the Judiciary.

The judge granted a period of 24 hours to comply with the order, warning that, if not complied with, the federal Public Prosecutor’s Office would be contacted for contempt, a crime that could lead to up to seven years in prison.

The president stressed that the judge accepted a procedure promoted by bodies that do not have the power to present these unconstitutionality processes, such as political parties.

He stressed that the reform of the Judiciary, being constitutional, complied with all the guidelines established to modify the Constitution, so the reform is legal

“We are acting in accordance with the law, those who are violating the rule of law are them,” he asserted.

When asked if she sees a political trial against Juárez Salas as viable, the president responded that it is not about that, and only a complaint will be filed with the Federal Judiciary Council (CJF).

“Because from our point of view, this suspension is not in her (the judge’s) duties, let the CJF analyze it, we are not going to enter into political trials. We Mexicans want this process to advance.”

Sheinbaum ruled out that this resolution is an attempted soft coup or the so-called lawfare (legal war)—which have occurred in other Latin American nations with progressive governments from the judicial sectors.

Instead, he considered that it is an attempt by judges, male and female judges, male and female ministers, and ministers to maintain their privileges.

Regarding the first statements they gave in their morning conferences that members of the Judiciary are giving from today, the head of the Executive was clear: “there has already been a constitutional reform, it is already part of the Constitution.”
