Madrid. For the first time in history, the attorney general of the Spanish State, Álvaro García Ortiz, one of the most relevant figures in the penal system, will be tried by the Supreme Court for a crime of revealing secrets, after disclosing personal data related to the case against Alberto González Amador, the partner of the president of the Community of Madrid, Isabel Díaz Ayuso, accused of tax fraud. The head of the Prosecutor’s Office issued a note in which he announced that he will not present his resignation with “the conviction that continuity in office is the least burdensome and most prudent,” after also receiving the support of the government, chaired by the socialist. Pedro Sánchez, and by the two parties that form the coalition in power, the Spanish Socialist Workers Party (PSOE) and Sumar.
García Ortiz was appointed by President Sánchez, although once he assumes office, as established by the statutes, he has autonomy to act, especially when he is the head of the fiscal structure that investigates crimes related to the exercise of power, such as acts of corruption, nepotism or negligence. After the Criminal Chamber of the Supreme Court announced his indictment, a milestone in the country’s democratic history, prosecutor García Ortiz announced his “intention to continue exercising my responsibilities as Attorney General of the State” and warned that he had called although this situation It is “unprecedented in our country and forces us to carry out a deep reflection on the facts that motivate it, the circumstances that surround it and the consequences that it may generate not only in the future actions of the Public Prosecutor’s Office, but in the entire Spanish Justice system.”
President Sánchez himself already stated a few months ago, given the possibility of this scenario occurring, that the government will support the prosecutor and in no case was he in favor of his resignation. In the midst of this judicial and political storm, the Anti-Corruption Prosecutor’s Office asked the Supreme Court to, given its status as a certified person, begin the procedures for the indictment of José Luis Ábalos, currently a deputy without a party, but who was President Sánchez’s right-hand man during his first stage in the government, serving as Minister of Development and as secretary of organization of the party. He is accused of several crimes, including bribery, influence peddling and criminal organization.
