29-year-old sentenced to death after kick in the stomach in Graz

The man attacked another man in January and, among other things, gave him a powerful kick in the stomach. The victim then died of a fat embolism. However, the jury did not recognize any intent to kill. Therefore, he was not found guilty of murder. The judgment is not final.

“No intent to kill”

The process had already started a week ago. The accused had always denied any intention to kill. Four of the jurors believed him and voted against murder, while the other four lay judges saw no intent to kill. In case of doubt, the 29-year-old was therefore not convicted of murder. However, all eight jurors agreed on intentionally causing serious bodily harm.

Severe internal injuries

The victim suffered serial rib fractures as well as a ruptured spleen and a liver as a result of the kicks outside a bar. This caused a fat embolism and the man died on the spot. The accused also tried to seriously injure another opponent.
