The Court of Appeal did not reduce the sentence of a 25-year-old man convicted of child rape.

The 15-year-old girls were victims of shocking crimes in the summer of 2023.
The teenagers had spent a warm summer day drinking alcohol. They were already heavily intoxicated when the other asked a man he knew from before to give them a ride back to the family support center where they were placed.
The man picked up the girls and drove them to the parking lot of the kindergarten next to the facility. In the parked car, the man started kissing and touching the girls. He forced a girl he knew from before to perform oral sex.
The 24-year-old man did not let the girls out of the car, but drove to the parking garage of the nearby Prisma. There, the man raped the friend of the girl who asked for a ride. Even after this, he drove his car a couple of kilometers away to a more secluded sandy parking lot and raped the girl again.
In the end, the man gave the girls a ride back to the family support center. The director took one of the girls to the emergency room, where she told about the sexual violence she had experienced.
He denied the crimes
When the matter was discussed in the district court of Itä-Uusimaa, the man denied that he knew that the girls were under 16 or intoxicated.
Although the man’s story changed several times, he vehemently denied having committed the crime.
The district court found the girls’ story more credible than the man’s. It considered that the man had a duty to find out and verify the real age of the girls before any kind of sexual intercourse.
The court sentenced Mohamad Jomaa Al Hamadishin three counts of child rape and two counts of sexual assault on a child. The joint prison sentence for the acts was 4 years, 2 months and 20 days.
In addition, Al Hamadish was sentenced to compensate the victims a total of 14,500 euros for the suffering and pain caused by the crimes.
He appealed his sentence to the Court of Appeal, demanding that the charges and claims for compensation be dismissed. He still denied having committed the crime.
The Helsinki Court of Appeal accepted the district court’s arguments and conclusions about the course of events, and did not change the man’s sentence. Currently, the 25-year-old man remains in custody.
