The case of text messages sent to citizens’ mobile phones by the staff of Haris Doukas in support of his candidacy for the presidency of PASOK, in the context of the internal party elections, takes on political and legal dimensions.
The alleged sending of unsolicited electronic communication is under the microscope of the Personal Data Protection Authority. At the same time, the independent Authority announced on Monday, September 16, 2024 that, following the submission of relevant complaints, it immediately initiated a process to examine the issue. In its announcement, in which the complainant is not mentioned by name, the independent Authority points out:
“In response to questions raised by the Mass Media regarding the alleged sending of unsolicited electronic communication by a candidate for the leader of a political party ahead of elections, the Authority announces that, following the submission of relevant complaints, it has immediately initiated a process to examine the matter.”
It is worth noting that a few days ago there were denunciations in the media about illegal sending of messages to citizens’ emails and phones in the context of the Duka campaign ahead of the internal party elections. In fact, the issue was “raised” with his statements by the Minister of Health, Adonis Georgiadis, who in a radio show (Parapolitika 901 FM, September 13, 2024) called on Haris Doukas to be careful where he sends messages and related it to the case of the former ND MEP Michel Asimakopoulou (email gate) in an attempt to both oppose the Duke and downplay the issue of the leak and use of expatriate email addresses. In a comment at the time, the Press Office of Haris Doukas had pointedly commented that “in the end, Maximos will ask for our arrest. They prove it every morning with the bigoted attacks from their well-known supporters in the media. Today they discovered a new theory that we should be silent candidates, not to inform anyone about our positions. They are giving everything, but they will not bend us.” In a postscript to their comment, the Douka staff added that “the truth is that the registers we use concern citizens who have participated in previous collective electoral internal party procedures of PASOK. Anyone who wishes, we can inform them in which process they participated”.
Three days later came the intervention of the Personal Data Protection Authority which announced that it had initiated an examination process for the alleged sending of unsolicited electronic communication by a candidate for the leader of a political party ahead of the elections. On the same day, PASOK’s candidate for president and mayor of Athens, Haris Doukas, after declaring that he was sending messages from the same registry as his fellow candidates, referred to “hits” against him and his colleagues by ND agents and pointed out that the society will give an answer with their vote in the PASOK elections for the leadership of the party. The statement made at noon on Monday (September 16, 2024) by Haris Doukas is as follows:
“A few days ago, Mr. Portosalte, after the public exhortation of Mr. Adonis Georgiadis, persistently called on the independent Authority for the Protection of Personal Data to start an investigation against me for the sms, with which I inform the citizens about my actions.
Finally today they were listened to.
To inform them that I am sending messages from the same register that my co-candidates are sending.
But Mr. Portosalte and Georgiadis have me as their only target.
Let them know that the more their blows to me and my associates increase, the more they strengthen us. Society will answer them at the polls on October 6.”
For days now, Mr. Portosalte, after the public exhortation of Mr. Adonis Georgiadis, has been persistently calling on the independent Personal Data Protection Authority to start an investigation against me for the sms, with which I inform the citizens about my actions.
