We would advise the self-appointed “judges” and “prosecutors” to accept the basic principles of the rule of law and in particular to recognize that the only competent ones are the judges and the prosecutors”, the Supreme Court Prosecutor’s Office said in a statement, on the occasion of publications about the investigation for possible rape in Mykonos.
In particular, in her statement she states: “On the occasion of publications in the electronic press regarding a complaint about the commission of the crime of rape in a tourist resort, we point out the following:
The secrecy of the preliminary investigation is a basic principle of a fair trial. The most frequent, unfortunately and definitely illegal tactic of selectively leaking information about the content of criminal files, which are in fact at the stage of preliminary examination, such as the case at hand and the presentation as data of factual events which, however, do not constitute the content of the file, has as a consequence the misinformation and creating impressions on public opinion.
This tactic has the obvious aim of creating a feeling of insecurity in the citizens, insulting the effectiveness of the Greek justice system and, consequently, defaming the country.
We would advise the uninvited “judges” and “prosecutors”, who like in any capacity to report facts, acts, or omissions especially in cases of criminal interest, without knowing the details of a case file, having no right to do so according to our legal culture, to offer a basic service to society as a whole: To accept the basic principles of the rule of law and in particular to recognize that the only ones competent to judge, according to the Constitution and the Laws, are the judges and prosecutors of the Country. Those who, being checked daily by their competent institutions, defend the rights and assign the obligations of the citizens during the examination of each case before them.
If this is not their intention, let them consider the cost of eating away at their credibility, when, unfortunately for them, they are too often disproved.”
