Faster, easier and simpler compared to the past, it foresees that the procedures in the Land Registry will now be processed, after the passing of the new draft law that the Minister of Digital Governance, Dimitris Papastergiou, put in a public electronic consultation from Friday.
The draft law eliminates the paperless process, with a new digital platform which will provide a solution in 1/3 of the time, while it includes special arrangements by which, for example, it returns to the owners the plots that had been classified as forest after appeals and arbitration, while they had been declassified and their former owner could not claim them.
In particular, it is about the draft law of the Ministry of Digital Governance entitled: “Completion of land registration, simplification of procedures, use of artificial intelligence and provisions for the operation of the n.p.d.d. “Hellenic Land Registry”, other provisions of the Ministry of Digital Governance”. The consultation will last until September 6, while the goal is to have it voted on by the middle of the same month.
According to what they had presented during the Council of Ministers at the end of July, Dimitris Papastergiou and the Deputy Minister of Digital Governance, Konstantinos Kyranakis, the goal is to complete Land Registration by 2025, to integrate Artificial Intelligence into the legal control of contracts and to simplify the real estate transfer procedures.
Land registry: How it will change for the benefit of owners
- The acceleration of the cadastral process, in order to achieve the goal of transitioning the entire country to a functioning cadastral system within 2025, as well as the establishment of a new digital process for correcting geometric elements of properties,
- The simplification and acceleration of the procedures for the transfer of real estate, the registration of registrable deeds and the correction of cadastral records, in a functioning cadastral register, in order to avoid complex administrative procedures and long-term legal disputes,
- The use of artificial intelligence, as well as new applications, to further upgrade the services provided by the n.p.d.d. “Hellenic Land Registry”,
- The enhancement of operational effectiveness and efficiency in the organization and operation of the n.p.d.d. “Greek Land Registry”.
Artificial intelligence
In another chapter, the bill provides for the use of Artificial Intelligence in the legal control of contracts. A recommendation will be proposed and the auditor in turn will check the data and the proposed recommendation greatly speeding up the final conclusion.
This application is already in pilot mode and will enter normal mode from the date of the passage of the bill by the Parliament, which is expected in September.
The engineers
The draft law provides for the creation of a Register of Certified Land Engineers. From his inclusion in the register, the Certified Engineer acquires the right to carry out an inspection and make a decision in case of timely submission of reasoned objections. The status of certified land registry engineer is acquired:
- By engineers of the Spatial Data Management Sub-Directorate of the n.p.d.d. “Hellenic Land Registry”, following a relevant decision of the Board of Directors of the n.p.d.d. “Hellenic Land Registry” or
- by private engineers, with their registration in the register, upon submission of an application by the candidate who has the appropriate qualifications as prescribed by law.
An end to the impasse of forestry
The bill aspires to provide a solution to cases that have been pending for years and concern thousands of owners who have differences either with the characterization of forest areas of a small part of their estates, or with errors in old Land Registry studies by promoting easy and quick corrections.
It includes special arrangements by which it returns to its owners plots that were classified as forest and after appeals and arbitration while they were declassified the former owner could not claim them, as with the new draft law this obstacle is removed.
The transfers
The arrangement for unilateral modification of the composition of the horizontal property is considered important, when a small difference is found between the measurement of square meters by modern means and the square meters in the old contract. Today thousands of landlords are locked in this impasse, which the bill aims to solve.
In addition, the new framework promises easy and quick corrections to the mistakes of old Land Survey studies, with the abolition of the paperless process, as a new platform will provide a solution in 1/3 of the time.
