A lawyer for the woman who beheaded her daughter says they are evaluating the possibility of appealing the enforcement action

Juan Concepción, lawyer for Ana Josefa García, the woman who admitted to beheading her six-year-old daughter, says that they are going to evaluate the possibility of applying for the measure compulsory imposed by the Ministry of Public for 12 months of protective detention in Najayo Mujeres, because they identify it as excessive.

The legal professional assured that the accused was not within his mental faculties. He said that if a person in a state of dementia commits a crime, he cannot be considered criminally responsible because the health condition interferes with what he did normally.

Because the Adjudication Office of Long-Term Care Services of Santo Domingo Este, psychiatric evaluation of the accused, willing to be done in National Institute of Forensic Sciences (Inacif)the judge said that before the judicial body instituted preventive detention, they should rely on the results of the psychological evaluation to clarify whether the person is capable of facing criminal proceedings or not.

It is remembered that Ana Josefa García Cuello, a doctor by profession and a member of the World Health Organization Dominican Republic Armywas arrested by members of the National Police Last Thursday, the 15th of this month, in his home, located in Razón 1 Residential, in the department of Isfapol, the city of Santo Domingo Este, in flagrante delicto.
