The Tax and Customs Police of the SRS wants to initiate a criminal prosecution for the payment of “envelope” salaries​​​​​​​in excess of one million euros

In August 2024, the Tax and Customs Police Department of the State Revenue Service (hereinafter – SRS) sent criminal proceedings against three persons to the Tax and Customs Prosecutor’s Office to initiate criminal proceedings against three persons for salary to pay ​​that is not reflected in the accounting records in a large amount, not to pay personal income tax and not to make mandatory contributions to insurance social of the state. An “Envelope” salary was paid in a trucking company.

At the first stage of the pre-trial investigation, procedural actions were carried out in March 2023, including investigations of items related to the company’s economic activity, when various material evidences were presented go, including. money intended to pay an “envelope” salary.

During the subsequent pre-trial investigation, it was established that the company paid employees’ wages that were not reflected in the accounting records in the amount of 1.2 million euros between August 2019 and March 2023, and also avoided taxes to be paid in almost a million euros. .

As part of the criminal process, the process of applying coercive measures to the legal entity was initiated, in addition to solving property issues, real estates worth more than half a million euros were seized.

The criminal process was introduced to initiate a criminal prosecution based on the indications of a crime provided in the Criminal Law 217.1 in an Article and in the second part of Article 218 – violation of wage regulations and tax evasion.

According to Article 19 of the Law on Criminal Procedure, a person is not considered guilty until he is found guilty of committing a crime according to the procedures specified in the Law on Criminal Procedure.
